On 5/29/2026 at approximately 2130 hours, I, Officer Haven, was working a license checkpoint at the intersection of Varnell Main St and Cedar St, when the listed vehicle, a white 2007 Ford Edge, FL-[REDACTED], approached the intersection from Cedar St.
I walked up to the vehicle and asked the driver for his driver’s license and smelled a strong odor of an alcoholic beverage coming from the vehicle. I also saw a 12 pack of Miller Light cans in the passenger seat that was open. I asked the driver, Mr. Jeremy Basquez, how much alcohol had he consumed tonight and he stated that he had only 2 beers. I then had him pull over to the side for suspicion of DUI.
I had the driver step out of the vehicle. I asked him if he would do any tests to see if he was safe to drive and he stated that he would. I then had him get into the starting position. I had him take off his hat and glasses. I then had him get into the starting position. I then checked for equal tracking and equal pupil size.
Mr. Basquez had equal tracking but did not have equal pupil size. When he was asked about it, he stated that he took a piece of shrapnel to the eye when he was on active duty in the United States Marine Corps years ago. I then gave him the instructions for the test. I asked him if he understood them and he stated that he did. I then began the test. During this test, I noticed a lack of smooth pursuit in both left and right eye. I then moved to the next test.
I had the driver get into the starting position. I then gave him the instructions and demonstrated the test. I asked him if he understood the instructions and he stated that he did. I then told begin when he was ready. Mr. Basquez stopped to steady himself on step 1 and 4 on the first pass. He missed heel to toe. He then turned improperly and stopped again to steady himself. He then took the improper number of steps back, taking 10 steps instead of 9. We then moved to the next test.
The next test was the one leg stang. I had the driver get into the starting position. I then gave him the instructions and demonstrated the test, I asked him if he understood them and he stated that he did. I then told him to begin. During the test, Mr. Basquez swayed, hopped, and put his foot down. I had to stop this test before the 30 seconds ended due to his safety.
I then asked him again how much alcohol he had consumed and he stated that he only had 2 beers. I then told him that he was showing signs that he was impaired beyond 2 beers and he stated that he was sorry, but that was all that he had. I then had Sgt Williams administered a PBT to detect alcohol. Alcohol was detected.
I then placed Mr. Basquez in custody for suspicion of DUI, based on the admission of alcohol consumption, the strong odor, and the results from the field tests. Due to existing injury sustained from his time in the Marine Corps, I handcuffed Mr. Basquez in front of his person. I searched him for weapons and contraband, none were found.
I then read him the Georgia Implied Consent Notice for suspects 21 years or older and requested a breath test. Mr. Basquez agreed. I then searched the rear of my patrol car for weapons and contraband, none were found. I then placed him in the back of my patrol car.
I then asked Mr. Basquez if he could get someone to pick up his vehicle and he stated that he could not get anyone to come and get it. It was then towed with the next list wrecker service, Union Point Towing. I then took an inventory of the vehicle and noticed that Mr. Basquez moved the open case of beer to behind the passenger seat.
I then located an empty can of Miller Light in the passenger floorboard. I grabbed it and it was still cold. I then placed it back in the cup holder so that I could move the seat and get the case of beer from behind the passenger seat. I then looked inside and it was a 12 pack that had only 3 beers left and they were still cold and precipitating. Pictures were added to the case file and the cans were left inside the vehicle.
I then transported Mr. Basquez to the Whitfield County Jail. While at the jail, I conducted the breath test on the Intoxilyzer 9000 instrument SN-90-001865. The first text had a 0.02 error, so in accordance with training, I waited 20 minutes from the last test to test again. The final text was successful and read a 0.125 BrAC.
I then completed a DD-1205 License Suspension form and served Mr. Basquez with his suspension. He was then turned over to jail staff without incident. I then searched the rear of my patrol car for weapons and contraband, none were found. Mr. Basquez was charged with DUI and open container. Copies of the citations, ALS form, and Intox forms were scanned and added to the case file.
