On this date, 1-14-26, I was dispatched to this address in reference to threats and trespassing. When I arrived I made contact with the manager of the store, [WITNESS #1]. He met me in the parking lot and pointed to a male and female that were sitting on some steps nearby. He stated the couple had been in the store several times over the past few days not buying anything and just hanging around the “ding ding” machines.
He stated that today he told them both to leave and the male began screaming at him and arguing with him about making them leave. He advised that his yelling and screaming placed his employees in fear for their safety and he wanted them trespassed from the property.
I then made contact with John Lewis and [REDACTED]. John immediately started continuing the same behavior with me as was described to me by [WITNESS #1]. John started cussing at me and saying that he wanted my supervisor there. I told him that I needed his identification in reference to a report for the disturbance he caused inside the store and the manager wanting him trespassed.
John refused to give me his ID or to identify himself. John continued to yell and scream obscenities at me and I could see other customers in the parking lot looking uneasy about his outburst. I then advised John that he was under arrest for disorderly conduct due to his actions inside the store and his continued behavior in the parking lot.
I reached for John’s right hand and he advised that he was refusing to be arrested and he wanted my supervisor. I told John multiple times that he was under arrest and the he needed to stand up and place his hands behind his back. John refused these commands several times. John finally listened when I asked for more units to come to the scene. He stood up and placed his hands behind his back at this point and started to try to apologize for his behavior. I placed John in the back seat of patrol vehicle after a search incident to an arrest was completed.
I then spoke to [REDACTED] and advised her that she was trespassed from the property. She had no issues with providing her information for the report and advised that she understood that she was trespassed from the property.
I transported John to the Whitfield County Jail and handed him over to booking staff. I charged John with disorderly conduct and misdemeanor obstruction on warrant #W26-85 which was approved by Judge Martin. I took no further action and this case will be closed by arrest.
During this incident the suspect was advised that they were under arrest. The suspect was searched incident to the arrest. My patrol vehicle was searched prior to and following the transport of the suspect. The suspect was secured in a seatbelt during transport.
While at the jail my department issued side arm was secured in a locker. The suspect and their belongings were handed over to booking staff at the jail with no issues. Booking staff was made aware of any medical or security risks at the time of handing them over. The suspect advised that they are a U.S. citizen.
