On 09/13/25, at approximately 03:44, I responded to the Hamilton Medical Center, room 20, to meet with the complainant wishing to report a physical domestic that occurred tonight.
Upon arrival, I met with [VICTIM #1], the complainant and victim, [WITNESS #1], her friend who transported her to the emergency room, and [VICTIM #1]’s brother, [REDACTED]. [VICTIM #1] explained to me that she was at her residence at [1800 BLOCK] Brady Dr, Unit [REDACTED] with her two daughters, [REDACTED] and [REDACTED].
[VICTIM #1] stated that her boyfriend of eight to nine years and father of her two daughters, Jose Angel Castro, was out with some friends for the night. He returned to the residence at around 0100 hours. When he returned, [VICTIM #1] stated she was on the phone with a male. Jose became very upset over this and began asking her for information regarding the male and her relationship with the male. [VICTIM #1] admitted to him the details of who the male was and their association with each other.
[VICTIM #1] stated that during this argument, Jose pushed her several times causing her to fall repeatedly. [VICTIM #1] showed me a scratch behind her left shoulder. She stated she got this scratch during one of the times Jose pushed her and she fell on the corner of a piece of furniture. She also showed me a significant carpet burn to her right glute. [VICTIM #1] stated she also received this carpet burn during one of the many times she fell to the floor.
[VICTIM #1] stated that during the argument, Jose also grabbed her by the throat and held her against the wall, leading to strangulation. [VICTIM #1] stated this felt like it lasted three to four minutes. [VICTIM #1] had redness on her neck that indicated this to be true, photo are attached to the report. [VICTIM #1] stated that she is unsure if he used both hands or just one during this incident. [VICTIM #1] stated that she is also unable to recall the exact sequence of events because everything occurred quickly.
[VICTIM #1] stated that after the physical altercations occurred, Jose walked outside with her Iphone 16 Pro Max in hand. She walked out behind him and they continued to argue over the male subject she was speaking to on the phone. [VICTIM #1] stated that Jose threw her phone onto the concrete causing it to shatter and no longer function. Jose then began throwing some of her personal belongings outside of their residence and telling her to leave immediately.
[VICTIM #1] was able to call [WITNESS #1] through her apple watch to pick her up from the residence. [WITNESS #1] stated that when she arrived, [VICTIM #1] was sitting outside with her belongings. [VICTIM #1] stated that at this point, Jose had locked her out of the residence. [WITNESS #1] immediately brought [VICTIM #1] to the emergency room to get checked after the strangulation occurred.
[VICTIM #1] stated that she did not wish for charges to be filed. I explained to her that due to this being a family violence incident, I would have to seek charges for Jose. After speaking to [VICTIM #1] about the severity of domestic violence incidents, she agreed that this reached a dangerous level.
[VICTIM #1] stated that Jose has been physical with her multiple times previously but that she never called the police. [VICTIM #1] stated she is done putting up with this behavior. I gave [VICTIM #1] a business card with the case number and told her I would be speaking with Jose. [VICTIM #1] agreed for her brother, [REDACTED], to pick up the children from the residence if I had probable cause for an arrest after speaking to Jose.
Officer Ellenburg and I decided to arrive to [1800 BLOCK] Brady Dr Unit [REDACTED] to speak to Jose. Jose stepped outside and I asked him to explain what occurred with [VICTIM #1]. Jose stated that he caught her talking to another male and he kicked her out of the house and that was all. I asked Jose to expand on the argument multiple times, explaining to him that I would like his side of the story so that I do not just have one side to make a decision on. Jose stated that he did not want to say anything else about the incident. I asked Jose to tell me about the physical part of the incident, and he again stated that he did not want to speak or expand on anything further.
Given the physical evidence of injuries on [VICTIM #1], [VICTIM #1]’s phone being broken, and her testimony to the incident, I place Jose under arrest. Jose initially tensed up when we were putting him in handcuffs, but after a few moments was compliant. I called [REDACTED] to arrive to the residence to pick up the children after receiving consent from [VICTIM #1] at the hospital. Jose stated he would be on his way.
Officer Ellenburg searched Jose incident to arrest, no contraband was found. I searched my back seat prior to placing him inside, no contraband was found. Jose was then secured in the seat belt. Jose confirmed he is a united states citizen. I gathered Jose’s phone and keys to take with me to the Whitfield County Jail. Officer Ellenburg stayed on scene waiting for [REDACTED] to arrive for the children.
I then transported Jose to the Whitfield County Jail. At the jail, my firearm was secured in the lock boxes located in the sally port. Jose exited my back seat and I searched it again, no contraband was found. I transferred custody of Jose over to Whitfield County Jail booking staff along with all his property. Booking staff was made aware that Jose recently had surgery to his hip and was still in recovery.
I filled out warrantless arrest from #70850 where I charged Jose with 16-5-21 (A) (3) Aggravated assault (FV), 16-7-23 (A)(1) Criminal damage to property 2nd degree (FV), and 16-5-23 Simple battery (FV). The warrantless arrest form was turned over to jail booking staff along with a criminal history report.
Jose Angel Castro committed the offenses of 16-5-21 (A)(3) aggravated assault (FV), 16-7-23 (a)(1) criminal damage to property 2nd degree (FV), and 16-5-23 simple battery (FV) when he, with his hands, choked the victim resulting in strangulation, threw the victims Iphone 16 Pro Max to the ground causing it to shatter and no longer function, and pushed the victim to the ground multiple times leading to the victim having a scratch mark on her left shoulder from falling on furniture and a significant carpet burn to her right glute.
All offenses done with the intention to of causing physical harm to the victim and damage to the victims property.
