On this date and time I was stationary at Highway 71 south of Maple Grove operating radar when I noticed a silver in color Chevy Trax approaching northbound at a speed of 71 miles per hour. After the vehicle passed I activated my marked patrol vehicle’s lights and siren conducting a traffic stop on the vehicle. The vehicle with Georgia registration of [REDACTED] came to a stop at the north Whitfield Middle School parking lot.

I approached the driver from their side and noticed two occupants inside at that time. I notified the driver, who was Kristi Swanson, for the reason the stop being that she was traveling 16 miles per hour over the legal limit. While she handed hers and the passengers Georgia driver’s license to me, I noticed two different types of alcoholic beverages in the floorboard in the back seat.

I noticed that her eyes were watery and that there was an odor of an alcoholic beverage coming from inside the vehicle. I asked if they had had any alcoholic beverages this date and Kristi Swanson advised that she had not but, her passenger had, who was Cierra Swanson. I then asked if there was any open containers inside the vehicle and they both advised that there was not.

I returned to my patrol vehicle and ran the registration and both Georgia driver licenses, finding all valid with no wants. I then requested for an addition officer to be enroute.

I returned to the driver and requested that she exited the vehicle and step to the rear.

I asked if she wore glasses and she advised that she did but, was not required to while driving. I then asked if she had any recent head injury or medical issues. She advised that she did not have any recent head injuries and that she took seizure medication. While talking with I could detect an odor of an alcoholic beverage coming from her person.

I then began Standardized Field Sobriety test. I performed the medical exam of horizontal gaze nystagmus and found both pupil equal size and tracking. I could detect nystagmus during lack of smooth pursuit and distinct and sustain nystagmus at maximum deviation. During the test I had to remind Mrs. Kristi Swanson several times to keep her head still during the test. I also noticed her swaying several times.

I then asked Mrs. Kristi Swanson if the lines on the parking lot was flat and level. She advised that they were. While instructing her to stand in the starting position she started walking down the line. I had her return to the starting position and notified her to stay in that position until instructed. She advised that she understood. I then demonstrated the walk and turn test. She advised that she understood instructions. During the test she missed heel to toe, stopped while walking to regain balance and conducted an improper turn.

I then instructed her to stand heel to heel and toe to toe with her hands by her side. She advised that she understood to stay in that position until instructed to begin the test. I then demonstrated how to perform the one leg stand test and she advised that she under stood instructions. During the test I noticed that she swayed and hopped.

During lack of convergence, her eyes did not cross.

I had her returned to heel to heel and toe to toe with her hands by her side. I then instructed her on how to perform the modified rhomberg test and she advised that she understood. During the test I noticed her swaying. She stopped the test at 19 seconds.

I instructed her on how to perform finger to nose and she advised that she understood. She missed 5 finger to nose touches.

I asked her again how many alcoholic beverages she had drank. She advised that she had 1. She also advised that the Michelob Ultra’s were hers and the Trulys were Mrs. Cierra Swansons. She advised that she bought the Michelob Ultras earlier before work. She also advised that she had smoke marijuanna CBD that morning. I had her blow in a portable breath test. The results showed 0.051.

I placed Mrs. Krisiti Swanson under arrest and did a back hand search of her person. I then placed her on my marked patrol vehicle’s rear passenger side seat. I read implied consent and she agreed to give blood.

I spoke with the Mrs. Cierra Swanson and asked if there were any open containers inside the vehicle. She advised that there was one inside her handbag. I located the truly alcoholic beverage. I asked who it was and Mrs. Cierra Swanson advised that it was hers. I then poured the content inside of the can out. While doing a search of the vehicle I noticed that the Michelob Ultras were sweating and were cold to the touch.

I then gave Mrs. Cierra Swanson a citation for open container inside motor vehicle (OCGA 40-6-253).

Mrs. [REDACTED] arrived on scene to retrieve Mrs. Cierra Swanson and the vehicle.

I advised Whitifield County dispatch of my mileage and transported. Mrs. Kristi Swanson to the Varnell City Hall for a blood draw. Lt. Small then collected the blood sample from her.

The blood sample was secured in to evidence.

I then transported her to the Whitfield County Jail. Mrs. Kristi Swanson received a citation for DUI-Combo any Combination A/A2/A3 (OCGA 40-6-391a4) and for exceeding the maximum speed limit (OCGA 40-6-181).
