On 03/24/2021 at 22:58 hrs, the Whitfield County Communications Center received a call regarding a structure fire at [3700 BLOCK] Chatsworth Hwy. Deputy Pack was on Chatsworth Hwy when he saw the call appear on his mobile terminal in his patrol vehicle. Deputy Pack arrived on scene at 22:59 hrs and saw flames coming out of the windows of the residence. As he exited his patrol vehicle, Deputy Pack saw a male and female near the residence in the driveway. Deputy Pack began yelling for the subjects to get away from the fire.

The female subject, later identified as [WITNESS #1], moved away from the residence. The male subject, later identified as Major Maggette, did not listen to Deputy Pack and got into the driver’s side of a mini-van that was parked in the driveway. Deputy Pack approached the passenger side of the van and noticed that Mr. Maggette had burns on his arms and a laceration on his neck. Mr. Maggette continued to refuse to exit the van and appeared to be in pain. Ms. [WITNESS #1] entered the driver’s seat of the van and Deputy Pack instructed her to slowly back it out of the driveway so they could get Mr. Maggette to a safer location. Once the vehicle was away from the fire, Deputy Pack asked Ms. [WITNESS #1] to hold pressure on the laceration on Mr. Maggette’s neck while he went to retrieve additional medical supplies. As Deputy Pack was returning to his patrol vehicle to get supplies, the Whitfield County Fire Department arrived on scene and began rendering aid to Mr. Maggette.

After Mr. Maggette was loaded into the ambulance and was being treated by EMS, one of the paramedics motioned for Deputy Pack to come to the side of the ambulance. He told Deputy Pack that Mr. Maggette had several wounds on both sides of his neck that appeared to be stab wounds. Deputy Pack used his body worn camera to take pictures of these wounds the best he could. Mr. Maggette said that the wounds were caused by glass and were not stab wounds. He would not elaborate any further about what caused the injuries. Deputy Pack asked Mr. Maggette what happened. He kept avoiding the questions and would not give an answer. While in the back of the ambulance, Mr. Maggette was not being cooperative with the EMS personnel and at one point said that he was not going to the hospital. Mr. Maggette’s brother, [REDACTED], arrived on scene and talked him into going to the hospital.

Deputy Pack spoke with several people while on scene. The first person he spoke with was [WITNESS #1], who is Mr. Maggette’s girlfriend. She said that she and Mr. Maggette have been together for approximately three years and have lived together in the residence for approximately one year. Prior to living in this house, they lived next door together for approximately two years. Ms. [WITNESS #1] advised that she works at Papa’s Pizza to Go in Dawnville. She got off work at approximately 22:00 hrs and arrived home at approximately 22:05 hrs.

When she got home, she saw smoke coming out of the living room window. She advised that at first, she thought it was a battery-operated candle but then realized it was smoke. Ms. [WITNESS #1] said that she went to the door and began banging on it and kicking it to get Mr. Maggette to come to the door. She estimated that she banged on the door for about five minutes. While knocking on the door she said that she could near the smoke detectors going off inside. Ms. [WITNESS #1] advised that Mr. Maggette finally opened the door and then fell out onto her, causing them both to fall down the stairs. Ms. [WITNESS #1] pointed to her neighbor’s residence and said that the neighbor saw Mr. Maggette fall out of the door. The neighbor she was referring to was Ms. [WITNESS #2]. Ms. [WITNESS #1] advised that she asked Mr. Maggette what happened and he told her that he did not do anything. She said that she was unable to get any further information from Mr. Maggette.

Ms. [WITNESS #1] advised that Mr. Maggette’s brother died approximately six months ago and the last three months have been rough on him. He has been depressed and according to Ms. [WITNESS #1], he has made comments about not wanting to be here anymore. She also said that the neighbor, Ms. [WITNESS #2], told her that she saw Mr. Maggette outside of the residence banging on something earlier in the day.

Deputy Pack, Lt. Boling and Sgt. Pierce walked to the residence behind [3700 BLOCK] Chatsworth Hwy and spoke with [WITNESS #3]. Mr. [WITNESS #3] advised that he was inside of his residence when he heard a popping noise coming from next door. He stated that the popping noise sounded like gunshots. Mr. [WITNESS #3] believes that he heard three shots. He said that when he looked outside, he saw that the house was on fire and called 911. Mr. [WITNESS #3] could hear a female yelling at someone to not go back inside of the residence but could not see anyone.

Deputy Pack then spoke with Ms. [WITNESS #2], who lives at [3700 BLOCK] Chatsworth Hwy. Ms. [WITNESS #2] said that she was inside of her residence and heard something banging outside. When she looked out her window, she did not see anything at first, but then saw Ms. [WITNESS #1] sitting on the porch of [3700 BLOCK] Chatsworth Hwy. She advised that Ms. [WITNESS #1] got into her van and sat in the driveway for approximately five to ten minutes. She then saw Ms. [WITNESS #1] leave the residence in her van. Ms. [WITNESS #2] did not think much about what was going on, so she put her daughter in the bathtub. Approximately five minutes later, Ms. [WITNESS #2] heard a popping noise outside and thought it was a gunshot. When she looked outside, she saw that the residence was on fire and saw Mr. Maggette laying in the doorway. She advised that Ms. [WITNESS #1] was nowhere near Mr. Maggette and she was near the van that was parked in the driveway. Deputy Pack asked Ms. [WITNESS #2] about seeing Mr. Maggette banging on something outside of the residence earlier in the day. She seemed confused by this and advised that she did not see him banging on anything. The only time she saw him outside today was when he let his dog out while she was in her yard.

Detective Burnette arrived on scene and Deputy Pack briefed him on the incident. The investigation was turned over to Detective Burnette and will remain active pending further investigation.
