On 2/16/25, at approximately 22:38, I responded to the intersection of North Dalton bypass and pleasant grove Dr SE in reference to a motor vehicle accident. As I got close to the intersection, dispatch advised me that one of the vehicles, a Red Chevrolet Truck, left the scene of the accident.
Upon arrival, I spoke to [VICTIM #1], the driver of the a White Toyota Camry. She informed me that she was waiting at the red light when a Red Truck came behind her and rear ended her vehicle. She stated that the driver of the Red Truck got out of the vehicle and approached her driver side window. [VICTIM #1] stated that the driver was a Hispanic male, about five feet and five inches tall, with a black and grey checkered sweater with blue jeans on.
She stated that the male was trying to convince her to fix the issue amongst themselves without involving law enforcement. [VICTIM #1] stated that this raised her concerns so she took a picture of the Red Truck’s license plate. She showed me the picture that showed a Georgia license plate [REDACTED]. I ran the license plate through GCIC. I contacted the registered owner, who informed me that he sold the truck to his nephew named Manuel. He stated that he does not know the address. I then checked the local involvements with the vehicle. Local involvements showed a Manuel Hernandez Arciniega associated with the vehicle in prior officer encounters.
I asked dispatch to send a Whitfield County deputy to the address listed in the local involvements screen. Dispatch confirmed that the deputies on scene made contact with the suspect vehicle. Pfc Pressley #443 stood by with the White Toyota Camry while it was being towed from the accident location. I went to [200 BLOCK] Satterfield Rd SE to meet with deputies on scene with the suspect vehicle and driver.
Upon arrival, Pfc O’Neal and I noticed a Red Chevrolet pickup truck with front end damage and a male matching the description given by the victim. He identified himself as Manuel Hernandez Arciniega. He admitted to being the driver of the Red Chevrolet truck during the accident. Arciniega stated he left the scene of the accident because the victim did not move to the side of the road or agree to fix the issue amongst themselves.
At this point, I made the decision to place Arciniega under arrest for leaving the scene of the accident and driving while suspended. As we placed him in handcuffs, Pfc O’Neal informed me that he smelled the odor of an alcoholic beverage emitting from his person. Pfc O’Neal searched him incident to arrest, no contraband was found. We sat Arciniega in the back seat of Pfc O’Neal’s patrol vehicle and secured him in the seat belt. I read Arciniega implied consent for drivers 21 years of age or older. He stated he understood them and agreed to state chemical testing of his breath. We then relocated to the Whitfield County jail.
At the jail, my firearm was secured in the lock boxes located in the sally port. Officer Murdoch #626 arrived at the jail to conduct the state test of Arciniega’s breath using the intoxilyzer 9000. The test yielded a positive result of a.277 BrAC. Custody of Arciniega was transferred over to Whitfield County jail booking staff. I cited Arciniega for 40-6-20 traffic signal violation (citation #640802), 40-6-270 leaving the scene of an accident (citation #640803), 40-6-391(p)(5) DUI 0.08Gm or more (3rd) (citation #640804), and 40-5-121 driving while suspended (citation #640805). I also filed out an administrative license suspension form.
The citations, drivers copy of the ALS form, and a copy of the intoxilyzer 9000 results were given to Whitfield County jail booking staff.
There were no known medical or security issues to pass along.
