On Saturday, August 22, 2026, at approximately 1423 hours, the Whitfield County Communication Center notified Deputy Vazquez that the Hamilton Medical Center had a female in ER room 7 who wished to make a report for domestic violence. Deputy Vazquez arrived in ER 7 and made contact with [VICTIM #1].
[VICTIM #1] stated that at approximately 1200 hours this date she and her sister were going to the flea market and asked her husband, Mauricio Hurtado-Hernandez, if he wanted to go with them, to which he declined. [VICTIM #1] stated that she left their residence at [REDACTED] and began driving to the flea market. [VICTIM #1] stated that she noticed that she left her purse at home and turned back around to go get it from the residence. [VICTIM #1] walked into the residence and stated she heard Mauricio on the phone talking to who she believed to be another woman.
[VICTIM #1] stated that she had caught Mauricio texting other women but never to the extent that she believed he was having an affair. [VICTIM #1] confronted Mauricio and demanded to see his phone and proceeded to take his phone out of his hand. [VICTIM #1] stated that Mauricio demanded his phone be given back and proceeded to twist her arm so that she was holding the phone behind her back so far that she heard a popping sound. [VICTIM #1] stated she fell to the floor and attempted to stand back up again, to which she felt Mauricio proceeded to punch her in the upper back shoulder area and kick her in the legs.
Deputy Vazquez observed visible bruising and scratches on [VICTIM #1]’s legs that would be consistent with the long flat toe of a square boot. [VICTIM #1] also had marks on her back that appeared to be swollen. [VICTIM #1] stated that Mauricio also yanked on her shirt from behind, causing marks from her shirt to appear on her upper torso. Deputy Vazquez saw that makes but could not confirm if it was from prolonged sun exposure or from the attack that occurred several hours before arriving at Hamilton Medical Center. When asked why [VICTIM #1] came to the hospital hours later and didn’t call the police, she stated it was because her shoulder and arm hurt so bad from the way it was twisted and that her sister brought her.
[VICTIM #1] stated that this was not the first time that Mauricio has assaulted her, but she has refused to call due to him convincing her that it was her fault, him being the sole provider, and him convincing her and Juvenile 1 that if he goes to jail, they will never see him again.
Deputy Vazquez was able to speak with Juvenile 1 via telephone, who was present during the physical altercation. Juvenile 1 confirmed that she attempted to separate Mauricio and [VICTIM #1] once it became physical and that she observed Mauricio striking [VICTIM #1]. Due to [VICTIM #1] not speaking English and needing a translator, Juvenile 1 was able to reveal that the altercation took place in the driveway and not in the house.
[VICTIM #1] later confirmed that there are cameras on the property, but she did not have her cell phone due to Mauricio having her phone, and she still had his. Deputy Vazquez took pictures of [VICTIM #1]’s injuries and went to [REDACTED] to make contact with Mauricio.
Off-duty Deputy Ramirez was contacted to translate due to the county and City not having any bilingual personnel on duty. Mauricio was questioned about the event that occurred earlier this date, to which Mauricio claimed that nothing happened and was not forthcoming about information and requested multiple times to know what [VICTIM #1] said. Once asked if he and [VICTIM #1] got into an altercation, he denied anything happened, and he did have her cell phone on the charger in the house.
Deputy Vazquez observed that Mauricio was wearing boots that had a square toe that was consistent with the injuries that [VICTIM #1] had on her legs. Wrist restraints were placed on Mauricio’s wrists, and he was escorted to the back seat of Deputy Vazquez’s patrol vehicle. Mauricio was transported to the Whitfield County Detention Center.
Mauricio was turned over to the booking staff without incident, and Deputy Vazquez filed for a warrant through the magistrate court. Judge Griffin granted Deputy Vazquez a warrant (W26-1450) for OCGA 16-5-23.1 Battery Family Violence and OCGA 16-5-70 Cruelty to Children in the 3rd degree. Deputy Vazquez served Mauricio with his warrant. All photos were uploaded to evidence.com.
