On November 09, 2025, 1720 hours, Deputy Beach and Deputy Vazquez were dispatched to [300 BLOCK] McCormick way, Dalton, Ga, 30721, for a domestic dispute. Dispatch notified deputies that the caller, [VICTIM #1], would be standing in his driveway. Dispatch also advised deputies that [VICTIM #1] was scared to go into his house due to his wife, Neyda Nunez, having a firearm inside.
When deputies arrived, they met with [VICTIM #1] and [JUVENILE #1] in the driveway. [VICTIM #1] advised that when he got home Neyda was upset due to him taking [JUVENILE #1] to the park to learn how to drive. [VICTIM #1] advised that when he entered the house Neyda grabbed him by the face and kneed him between the legs. [VICTIM #1] advised that him and Neyda went into the Master Bedroom to talk so they weren’t in front of the kids.
[VICTIM #1] advised that once in the bedroom Neyda blocked the door way and would not allow him to leave. [VICTIM #1] advised that Neyda stated she wanted a divorce, but he said that he did not want to talk to her about divorce because during prayer God told him that he needed to “show God love.” [VICTIM #1] advised that he then attempted to jump out of the bedroom window to flee from Neyda but Neyda grabbed him by the shirt and pulled him back inside and pushed him onto the bed.
[VICTIM #1] advised that while on the bed Neyda wrapped his shirt around his neck causing him to struggle breathing but he was able to overpower Neyda and loosen the shirt and push Neyda to the ground and ran out of the house. [VICTIM #1] advised that Neyda got a gun out of his car and took it inside. [VICTIM #1] advised that’s when he called 911.
Deputy Kadinger arrived on scene while Deputy Beach and Deputy Vazquez were speaking to [VICTIM #1].
Deputies then Spoke to [JUVENILE #1]. [JUVENILE #1] advised that his mom was upset and that he has never seen her that mad. [JUVENILE #1] advised that he could not remember everything that happened but that he could hear [VICTIM #1] and Neyda yelling in the bedroom while he was in the kitchen. [JUVENILE #1] advised that [VICTIM #1] ran out of the bedroom without a shirt on.
Deputies then approached the house to attempt to contact Neyda. Deputy Vazquez knocked on the door of the house. Deputies saw [JUVENILE #2] walk from the kitchen into a room later identified as the master bedroom. Neyda then exited the bedroom and opened the door to allow deputies to enter the house.
Deputy Spivey and Deputy Ochoa arrived on scene when Deputy Beach, Deputy Vazquez, and Deputy Kadinger entered the house.
Neyda advised that [VICTIM #1] was upset with her due to her going to a concert the night of November 8, 2025. Neyda advised that [VICTIM #1] stated that he did not give her permission to go to the concert. Neyda advised that she then told [VICTIM #1] that she wanted to speak with him in the bedroom not in front of the kids. Neyda advised that once they entered the bedroom she stood in front of the door so that [VICTIM #1] couldn’t leave and told [VICTIM #1] that she wanted a divorce. Neyda advised that [VICTIM #1] stated that he didn’t want to talk about getting a divorce and attempted to exit the room through the bedroom window.
Neyda advised that while [VICTIM #1] was partially out of the window, she grabbed him by his shirt and pulled him back inside and onto the bed. Neyda advised she ripped [VICTIM #1] shirt off of him when she pulled him back into the bedroom. Neyda stated that while [VICTIM #1] was on the bed she wrapped his shirt around his neck until he started turning different colors and stated “I will get rid of you one way or another.”
Neyda advised that [VICTIM #1] was able to escape the room and left the house. Neyda advised that she asked [VICTIM #1] to give her the keys to the van and he refused to give them to her. Neyda advised that she then went and got the gun out of her son’s car due to her driving the car to the concert and put the gun in her vanity in the master bathroom.
Deputy Ochoa searched Neyda and Deputy Beach placed wrist restraints on Neyda. Neyda was transported to the Whitfield County Detention Center by Deputy Beach and Deputy Vazquez and turned over to intake staff without incident.
Deputy Beach applied for a warrant through Magistrate court and charged Neyda with OCGA 16-5-21 Aggravated Assault, OCGA 16-5-41 False Imprisonment, OCGA 16-5-40 Kidnapping, OCGA 16-5-70 Cruelty to Children in the 3rd Degree. Deputy Beach spoke with Magistrate Judge Weaver and was granted the warrant. Neyda was served Warrant# W25-1852. [VICTIM #1] was given Case# 2025-06220 and given a victim’s bill of rights form.
