Officer’s Narrative:

On October 30th, 2025, myself, and Officer Hill, responded to 1200 Memorial Dr, in reference to a fight in progress. Dispatch advised that public safety officers on scene requested us to emergency respond due to two extremely intoxicated individuals trying to fight them. While in route, dispatch advised the subjects were trying to leave the scene in a white Ford Taurus. Once on scene, we made contact with both individuals, Rayburn Smolik, and [REDACTED], sitting inside the vehicle in front of the emergency room entrance.

I then asked Rayburn who was sitting in the front passenger seat to exit the vehicle. He did so and I asked him to go stand by my patrol vehicle. I noticed Rayburn was unsteady on his feet when he exited the vehicle. He was also yelling and cursing. I asked Rayburn to calm down and tell me what happened.

Rayburn stated he received a phone call from the hospital stating his mother was being discharged. He stated he arrived at the hospital with his brother [REDACTED] to pick her up. Rayburn stated they entered the hospital and were met by public safety. Rayburn stated public safety began being rude and telling them they had to leave. He stated he just wanted to see his mother but they would not allow him to. Rayburn then stated one of the officers drew his ASP baton. I asked Rayburn why did the officer draw his baton. He stated for no reason. I asked Rayburn if it ever got physical between him and the officers and he responded no.

I then spoke with one of the victim officer, Ryan Fowler. Ryan stated he was at an emergency room with his partner, Adam Disinger. He stated they were standing by with an inmate that was brought in for stitches. Ryan stated [REDACTED] walked by them and dropped something on the floor. Ryan stated [REDACTED] yelled “god damn it” out loud and picked up the item from the floor. Ryan stated as [REDACTED] began walking again, he was very unsteady on his feet and was bouncing from wall to wall like a pin ball machine. Ryan stated he felt like he detected an odor of an alcoholic beverage coming from [REDACTED]’s person.

Ryan stated he stopped [REDACTED] and asked him where he was headed. Ryan also stated he asked to see [REDACTED]’s bracelet. Ryan stated [REDACTED] threw his hands up and began cursing again. Ryan stated he told [REDACTED] he needed to leave and began escorting him to the lobby area alongside Adam. Once at the lobby, Ryan stated [REDACTED] became more irate. Ryan stated [REDACTED] told them to quit following him but they denied his request. Ryan then stated [REDACTED] either said “I am going to kill yall” or “I am going to kill myself”. Ryan stated he was not sure what he heard but he believes he said he wanted to harm himself.

Ryan stated [REDACTED] then began running towards the top of the parking lot where Rayburn was trying to park the vehicle in a parking space. Ryan stated Rayburn got out of the vehicle and asked what was going on. Ryan stated he told Rayburn to get back in the vehicle and to circle around and they would figure something out in reference to their mother. Ryan stated Rayburn became irate and started cursing at them and advancing on them in a violent manner.

Ryan stated Adam told Rayburn to back up but he did not obey the commands. Ryan stated Rayburn continue cursing at them and then took his jacket off. Ryan then stated Rayburn clinched his fist as if he was getting in a fighting stance. Ryan stated he felt like Rayburn was going to physically attack him so he deployed his baton. Ryan stated Rayburn told him he was going to “kick his a*s”. Ryan stated he then called for more public safety officers over the radio for assistance.

Ryan stated Rayburn got back in the vehicle while still cursing at them. Ryan stated due to Rayburn’s behavior, he decided to call 911 to have us come out. I asked Ryan how he felt when Rayburn clinched his fist. Ryan stated he felt threaten. I asked Ryan how he felt threaten. He stated he felt like Rayburn was going to physically fight him. I asked Ryan if he wanted to press charges. He responded yes.

I then spoke with Adam. Adam stated he was by emergency room 9 with Ryan and an inmate who needed stitches. Adam stated [REDACTED] came by walking past them stumbling from wall to wall like a pin ball machine. Adam stated [REDACTED] dropped something on the floor and began swearing “god damn it”. Adam stated he told [REDACTED] to not swear out of respect for other patients. He also asked [REDACTED] if he was intoxicated due to him being very unstable on his feet. Adam stated [REDACTED] responded saying he had not been drinking.

Adam then stated he suggested to [REDACTED] to go to the lobby area. Adam stated they began walking towards the lobby. Adam stated [REDACTED] got upset because they were following him. Adam stated [REDACTED] began to sprint towards the parking deck and stated he was going to get his brother (Rayburn). Adam stated the followed him and [REDACTED] and Rayburn began to argue amongst themselves.

Adam stated Rayburn then got out of the vehicle and began to advance towards them very quickly. Adam stated Rayburn attempted to push pass them saying he was going into the hospital to get his mother. Adam stated they blocked his path to the entrance and advised him he was not going into the hospital. Adam then stated Rayburn clinched his fist and flinched towards Ryan as if he was going to strike Ryan. Adam then stated that is when Ryan drew his baton out.

Adam stated they attempted to get both of them to calm down but they would not. Adam stated Rayburn was very upset due to Ryan deploying the baton. Adam stated Rayburn said he was going to “kill all of them”. Adam stated they then called 911. I asked Adam if he wanted to press charges and he responded yes.

Based on both Adam’s and Ryan’s testimony, and them feeling threaten by Rayburn, the decision was made to arrest Rayburn. I advised Rayburn he was under arrest for disorderly conduct and simple assault. I then placed Rayburn in handcuffs. He was searched incident to arrest. I then placed Rayburn in the back of my patrol vehicle and secured him. I then transported him to the Whitfield County Jail. Once at the jail, I secured my firearm in the lock box. Rayburn was then turned over to booking personnel.

Rayburn was charged with the following on warrantless arrest number 70926:

  • 16-11-39 Disorderly conduct
  • 16-5-20 Simple assault

Both [REDACTED] and Rayburn were trespassed from the hosptial at the request of hospital security.
