I responded to 616 4th Ave, Tienda Tikal, in reference to a possible disturbance. Dispatch advised that someone had called the police stating that they had an emergency. Dispatch also advised that the caller had slurred speech and was difficult to understand.

Upon my arrival, Officer Teasly (668) and Sgt Bowen (363) were already on scene. They were standing with two males outside Tienda Tikal. As I approached, I observed that one of the males had blood on his face and the other had a torn t shirt. Officer Teasly informed me that there had been a disturbance inside the store. The two males outside only spoke Spanish, so I remained outside to speak with them and asked Officer Teasly to go inside the store to obtain statements.

I attempted to speak with the two males; however, communicating with them was very difficult because they both appeared to be very intoxicated and were not making much sense. From what I could understand from their statements, they said that they had been inside the store drinking with other people. They said that they started arguing with another person inside the store and were then told by “La Tienda” to leave.

They repeatedly stated that “La Tienda” told them to leave and then assaulted them. I asked them to explain who they meant by “La Tienda,” as that term means “the store” and does not identify a specific person. They continued to state that “La Tienda” had assaulted them, causing one of them to have blood on his face and the other to have a torn t shirt.

I asked them why they refused to leave when they were asked to do so. They said that they were arguing with another person and wanted that person to come outside and fight. They repeatedly stated that they had not caused any problems with the store and did not understand why the store employees had disrespected them. They also repeatedly stated that they had been drinking inside the store and paying for their drinks and did not believe the store should have kicked them out.

Once Officer Teasly returned, he advised me that the two store clerks, identified as [VICTIM #1] and [VICTIM #2], told him that the two males were very intoxicated and had been causing a disturbance inside the store. According to [VICTIM #1] and [VICTIM #2], the two males were screaming, arguing, and wanting to fight other people inside the store, making them fear for their safety and placing their property in danger of been damaged or destroyed. Officer Teasly said that [VICTIM #1] and [VICTIM #2] told the two males to leave the store several times, but they refused.

[VICTIM #1] and [VICTIM #2] stated that the two males attempted to hit them while they were pushing the males out of the store. [VICTIM #1] and [VICTIM #2] then locked the door after the two males were outside. They stated that the males then began banging on the door and demanding to be allowed back inside. [VICTIM #1] and [VICTIM #2] denied hitting either male and stated that they did not know how one of the males received the injury that caused blood to be on his face.

The two males were later identified as Remigio Mendez and Joel Mendez. Both Remigio and Joel appeared to be very intoxicated. They had slurred speech and had difficulty maintaining their balance. While I attempted to speak with them, they were very loud, spoke nonstop over me, and made several statements that I had difficulty understanding.

Based on the totality of the circumstances, including Remigio and Joel’s apparent level of intoxication, their admission that they had been drinking, their admission that they had been arguing and wanted to fight another person, their admission that they refused to leave when asked to do so, and the statements provided by [VICTIM #1] and [VICTIM #2], I decided to arrest Remigio and Joel.

I asked Officer Teasly to handcuff Remigio while I attempted to handcuff Joel. Joel pulled his arms away from me and would not remain still, as he was intoxicated making it difficult to place him in handcuffs. Sgt Bowen assisted me, and we were able to place Joel in handcuffs. The handcuffs were double locked.

I then went to assist Officer Teasly with Remigio due to his level of intoxication he would not remain still or place his hands behind his back. I grabbed one of Remigio’s arms and Officer Teasly grabbed Remigio’s other arm, and we were able to place him in handcuffs. The handcuffs were double locked.

I searched Joel in front of my patrol vehicle and did not locate any contraband. Officer Teasly searched Remigio and did not locate any contraband. We then placed Joel and Remigio in the back seat of my patrol vehicle and secured them with seat belts. Joel and Remigio are both Guatemalan citizens.

While transporting Joel and Remigio to the Whitfield County Jail, I asked them if they wanted the Guatemalan consulate to be notified of their arrests. They ignored the question and did not provide an answer. While inside my patrol vehicle, they began speaking about god and said that they were going to ask god to punish me. They also said that I was going to “fall by their hand.”

Upon arrival at the Whitfield County Jail, I turned Joel and Remigio over to booking staff. The back of my patrol vehicle was searched before and after transport, and no contraband was located.

At the jail, Remigio provided a breath sample on a portable breathalyzer, which displayed a reading of 0.287. Joel also provided a breath sample on a portable breathalyzer, which displayed a reading of 0.163.

I charged Joel on warrantless arrest form #71319 with the following offenses:

O.C.G.A. § 16-11-39, Disorderly conduct.
O.C.G.A. § 16-11-41, Public drunkenness.

I charged Remigio on warrantless arrest form #71320 with the following offenses:

O.C.G.A. § 16-11-39, Disorderly conduct.
O.C.G.A. § 16-11-41, Public drunkenness.
