On this day I Officer G. Castillo responded to [REDACTED BY AGENCY] in reference to a disturbance in progress. While en route dispatch advised that the parties involved were getting physical I then activated my emergency lights to expedite my time of arrival. Upon arrival the parties were only verbal. Officer Garcia and Officer Briner assisted with securing the scene.
I then spoke with [VICTIM #1], [WITNESS #1], [WITNESS #2] and [WITNESS #3]. [VICTIM #1] stated that his neighbor Ricardo Calderon parked in his parking spot. [VICTIM #1] stated that he told Ricardo to move his car. [VICTIM #1] then stated that Ricardo walked inside apartment [REDACTED BY AGENCY] and shortly after Ricardo’s mom [WITNESS #4] came outside and began to scream at him.
[VICTIM #1] then stated that he told [WITNESS #4] “whats the problem” and that is when Ricardo ran inside apartment [REDACTED BY AGENCY] and came out with a pistol and cocked it. [WITNESS #1], [WITNESS #2] and [WITNESS #3] all stated that they witness Ricardo come outside with a pistol in his hand and cock it.
I then spoke to [WITNESS #4] and she stated it was a airsoft pistol. [WITNESS #4] stated that [VICTIM #1] was acting crazy and that Ricardo would not do anything like that unless he felt her life was in danger. [WITNESS #4] stated this argument orginated over whos parking spot is whos. [WITNESS #4] stated that Ricardo ran away when he realized 911 was called.
At this same time Ricardo walked around the corner of the building with leaves scattered across his sweatshirt. I asked him if he had any weapons and he stated no. Before I asked him more questions I was interrupted by the yelling of both parties beginning to argue again. Due to this I felt it would be best to handcuff Ricardo and remove him from all other parties involved and speak to him one on one.
I then asked Ricardo if he would explain to me what happened and he stated “I pulled a gun on him” I asked him to start from the beginning and he stated that argument started over parking spots and that [VICTIM #1] got in [WITNESS #4]’s face calling her a b*tch. Ricardo then stated that he wasn’t going to let [VICTIM #1] disrespect his mom so he went inside grabbed his black Ops-M.R.P airsoft pistol and came outside with it and cocked it while saying “whassup whassup”.
I then read Ricardo miranda warning from my department issued miranda warning card. I asked Ricardo if he would take me where he left the gun. Ricardo stated yes. I then walked with Ricardo along side myself a Officer Brinner to locate the weapon which was hidden behind a green dumpster and under a bay door. I secured the firearm and removed the magazine which was loaded with small green plastic pellets. I then walked Ricardo back to my patrol vehicle #44 and secured him in the back seat. Ricardo informed me he is a US citizen.
I then trasnported him to WCSO. Upon arrival I secured my firearm in a sally port lock box. I then transferred Ricardo over to WCSO staff along with his property.
I applied for arrest warrant #w26-246 and charged Ricardo with the following
16-11-39 Disorderly Conduct
16-5-20 Simple Assault
This warrant was signed and approved by judge Griffin. I then served Ricardo with was warrant and informed him of his charges. I signed the warrant and handed it over to WCSO staff.
I then cleared my backseat from any of Ricardo property and secrued my firearm.
I then placed the black Ops-M.R.P airsoft pistol in property and evidence. Officer Garcia provided the simple assault victim with a victim’s rights notification form.
Cleared by arrest.
