On 05/18/2026, at approximately 0040 hours, I responded to 1200 Memorial Dr (Hamilton Medical Center) in reference to a disturbance in progress. Upon arrival, I met with public safety Officers Scotty Stone & Cody Kintz.
Scotty advised that they had a male, later identified as Robert Kellow, in ER room 19 refusing to leave the hospital. Scotty stated that Robert had arrived about 50 minutes ago with EMS, [REDACTED BY AGENCY]. Scotty stated that Robert’s doctor, [REDACTED], attempted to examine him but Robert would not stop screaming and cussing. Scotty stated that the doctor asked for public safety due to Robert’s behavior.
Scotty stated that when they arrived, Robert continued to cuss and yell at them. Cody advised that Robert was loud enough that everyone near his room could hear him. Scotty stated that they told Robert he needed to leave due to his aggressive behavior towards staff members. He advised that Robert refused to leave, saying that he was going to sue the hospital instead. Scotty stated that they wanted Robert to leave. He informed me that the doctor had cleared him to leave the hospital. It should be noted that Scotty informed me that Robert had been kicked out of several other hospitals over the last few months due to aggressive behavior.
I attempted to speak with Robert about his options since the hospital wanted him gone; however, he would ignore me and speak with his wife on the phone saying that she needed to hear what was about to happen. Robert made no attempts to leave the hospital or to find a ride. After trying for several minutes to get Robert to leave, the decision was made to arrest him for criminal trespass. The hospital provided me with Robert’ s discharge papers which stated that the doctor advised Robert was medically cleared.
I then placed Robert in handcuffs. With the assistance of other officers and public safety officers, Robert was transferred to a wheelchair and taken outside to my patrol vehicle. There, Officer Neal and I searched Robert incident to arrest. Robert was placed in the back seat of my patrol vehicle. Due to his supposed medical issues, he was not seat belted. Robert is a U.S. citizen. I then transported Robert to the Whitfield County Jail.
At the jail, my department issued firearm was secured in the sally port. Robert and his belongings were handed over to booking staff. Booking was advised of his medical complaint and were provided with Robert’s discharge papers signed by the doctor. The back of my patrol vehicle was searched prior to and following transportation.
I charged Robert on warrantless arrest form #69892 for OCGA 16-11-39 Disorderly Conduct and 16-7-21 Criminal Trespass. A criminal history was attached to the warrantless form.
