On February 3, 2025 at approximately 1925 hours Deputy McKenzie and Deputy Long were dispatched to [3000 BLOCK] Freedom Ln in reference to a disturbance in progress. Upon arrival, Deputy McKenzie met with “Rogelio Alvarez” outside of this location. Deputy Long went inside to speak with the caller “[VICTIM #1]”.
Mr. Alvarez stated he lives at this location with his mother “[VICTIM #1]” and his siblings. He advised he did not call law enforcement and did not wish to speak to Deputy McKenzie about anything that occurred on this date.
Deputy McKenzie spoke with Ms. [VICTIM #1] she stated that on this date she had finished cooking dinner and asked her son “Mr. Alvarez” to come inside to eat. She stated Mr. Alvarez was intoxicated when he entered the residence and asked for a ride to the store to get more alcohol. Ms. [VICTIM #1] began arguing with him because he was not supposed to be drinking due to him being on probation. While Ms. [VICTIM #1] was arguing with him he threw a lemon towards her. She threw the lemon back and told him to leave the residence. He then walked closer to her and placed his hand on her throat. He shoved against the refrigerator and began to strangle her with his hand. She said she could hardly breathe when he was strangling her. He did not stop until multiple other family members pulled him away from her. He then grabbed a butter knife and began to cut himself. Ms. [VICTIM #1] then called the authorities.
Deputy McKenzie spoke with “[WITNESS #1]” who also resides at this location. She stated on this date she and her family were eating. Ms. [VICTIM #1] told Mr. Alvarez to come inside to eat. When he entered the residence, he appeared to be intoxicated. He asked for someone to take him to the store to get more alcohol. He and Ms. [VICTIM #1] then began arguing about his probation and Mr. Alvarez threw a lemon at Ms. [VICTIM #1]. Ms. [VICTIM #1] threw the lemon back. Mr. Alvarez grabbed Ms. [VICTIM #1]’s throat and pushed her. He let her go and grabbed a butter knife. He began to cut himself on multiple parts of his body with the butter knife. Ms. [VICTIM #1] told him to leave the residence. He grabbed Ms. [VICTIM #1]’s throat a second time. This time he held onto her and began to strangle her. Ms. [VICTIM #1]’s face began to turn a different color. He continued to strangle her until Ms. [WITNESS #1]’s son “Juvenile 1” and additional relatives pulled Mr. Alvarez away from Ms. [VICTIM #1].
Deputy McKenzie observed Ms. [VICTIM #1]’s injuries from the incident. Her throat had redness around it. Her injuries were consistent with her being strangled by someone’s hand. Mr. Alvarez had a scratch on his face which was consistent with him attempting to harm himself with a dull object.
Mr. Alverez was placed into custody under warrantless arrest number 69938 for OCGA 16-5-21| aggravated assault, family violence, and OCGA 16-5-70(D) Cruelty to child, allow to witness felony/FV.
