Officer’s Narrative:

On 7.1.21 at approximately 1649 hours I, Ofc T. Hammontree, was assisting Ofc Mcbrayer at [500 BLOCK] Benton St, apartment A, in response to a disturbance.

The original caller, Susan Scruggs, was in an argument with her neighbors who were seated on the porch. I asked if we could speak inside her residence so she would remain separated from the other party. As I entered I observed a black male seated at a small couch in the main room. This male was identified as T***** W***.

While speaking with them, I observed in plain view a glass smoking pipe with white residue. I recognized this as a device commonly used for the inhalation of methamphetamine. When I asked who the pipe belonged to however, both individuals claimed they did not own the pipe. Scruggs then began saying that she recently found her door open and began to say the neighbors must have put it there.

I separated Scruggs from W*** and read her Miranda Rights which she stated she understood. I asked several times who the pipe belonged to which she denied any prior knowledge of it being in the residence. I asked Scruggs for consent to search her bedroom which she agreed. She stated that she does live alone and W*** was visiting, however she is the only person that stays in the bedroom.

Upon opening the top drawer of the small filing cabinet beside her bed I located two marijuana grinders, digital scale with white crystalline residue, and a small plastic cylindrical container. Within that container I observed a white crystal like substance that I suspected to be methamphetamine based on my knowledge, training, and experience. This substance was later field tested which resulted in a positive indicator for methamphetamine.

W*** consented to be searched with nothing of significance located. Scruggs was secured in handcuffs and escorted to my vehicle. She was transported to the Whitfield county jail and turned over to the booking officer without incident.

She was charged on warrantless# 64375 for the offense:

OCGA 16-13-30 possession of a controlled substance-meth
OCGA 16-13-32 possession of drug related objects
OCGA 16-7-20 possession of tools for the commission of a crime

All collected drug objects and suspected meth were entered into property and evidence. Conversations with Scruggs was recorded on car 60 dash cam audio.
