On September 14, 2025, at approximately 8:43 p.m., Deputy E. Garcia of the Whitfield County Sheriff’s Office, in the performance of his patrol duties responded to the Sutton Pharmacy located at 3957 Cleveland Hwy for a call of service regarding to a Bolo incident.

Prior to arriving at the designated address, Whitfield 911 Communications acknowledged that the described alleged offender was in a gray Honda. 911 also acknowledged that the caller advised he was leaving Little Murray when another vehicle sped up behind him while flashing its lights at him. 911 further acknowledged that the caller stated he allowed the offender vehicle to pass, but the offender then stopped and fired a weapon at him.

Upon arrival, Deputy E. Garcia observed that Officer D. Hill of the Varnell Police Department and Officer C. Blair of the Cohutta Police Department were speaking with the driver of a gray Honda Accord bearing Georgia tag [REDACTED]. Deputy E. Garcia observed that the driver, later identified as Terry Adam Walden, stated that he had a gun inside his vehicle.

Deputy E. Garcia observed when Officer D. Hill asked Terry if they could secure the firearm (serial number LET4408) while the investigation was being conducted. Deputy E. Garcia observed that Terry agreed and permitted Officer D. Hill to secure the firearm. Deputy E. Garcia observed that Officer D. Hill asked Terry to step out of the vehicle and placed him behind the Honda Accord.

Deputy E. Garcia spoke with Terry, who stated that he had been coming from the Circle K gas station located at 4187 Prater Mill Rd. Officer D. Hill advised Deputy E. Garcia that while securing Terry’s firearm, he observed a shell casing in the chamber. Deputy E. Garcia then read Terry his Miranda rights. Terry stated that he did not wish to make any statements.

Deputy E. Garcia notified Whitfield County Communications Center (Dispatch) to advise the caller, later identified as [VICTIM #1], to come to the scene to identify Terry’s vehicle.

Deputy E. Garcia spoke with [VICTIM #1], who identified Terry’s vehicle as the offender vehicle. [VICTIM #1] stated that he had been driving with his children from Little Murray when he observed Terry approach from behind while flashing his headlights. [VICTIM #1] stated that he moved into the right lane in order to let Terry pass. [VICTIM #1] stated that he also signaled with his hand for Terry to go ahead and pass. [VICTIM #1] stated that after Terry passed, he continued driving behind him. [VICTIM #1] stated that after some time, Terry pulled up alongside him and fired a firearm as he drove past.

[VICTIM #1] stated that when he was passing Terry’s vehicle, he observed the driver’s side window of Terry’s vehicle roll down. [VICTIM #1] stated that once the window rolled down, he observed a flash as if a firearm had been discharged, and at the same time, he heard a loud “bang” consistent with the sound of a gunshot. [VICTIM #1] stated that his vehicle did not sustain any damage and he did not suffer any injuries. [VICTIM #1] stated that his son, later identified as [JUVENILE #1], had also witnessed the incident.

Deputy E. Garcia spoke with Terry a second time and asked him if he had anyone who could come to the scene and take possession of his vehicle. Terry stated that he did not have anyone. Deputy E. Garcia notified Dispatch to send a wrecker from the on-call list. Deputy E. Garcia conducted an inventory of the vehicle. Coins, green slime, 2 Gatorades, 2 pairs of black shoes, a box of water, a pair of boots, 1 Invisible Glass spray, green vest, silver coat, 1 tobacco, beige pants, and a black LAG tactical holster.

Deputy E. Garcia asked [VICTIM #1] if he could speak with [JUVENILE #1] regarding the incident. [VICTIM #1] permitted Deputy E. Garcia to do so. Deputy E. Garcia approached [JUVENILE #1] and observed that he was nearly in tears, visibly shaken, and appeared scared. Deputy E. Garcia spoke with [JUVENILE #1], who stated that he observed the driver’s side window of Terry’s vehicle roll down and saw Terry withdraw a firearm. [JUVENILE #1] stated that he observed Terry point the firearm in their direction and fire it, and he heard a loud “bang” consistent with a gunshot.

In conclusion of the investigated incident Deputy E. Garcia reasonably believes the state’s violation of aggravated assault, cruelty to children in 2nd degree, and cruelty to children in 3rd degree was committed by Terry Adam Walden therefore he was taken in custody, handcuffed checking for fit and double locked. Terry was then transported to the Whitfield County Sheriff’s Office Detention Center.

Terry is being charged with three counts of O.C.G.A. 16-5-21 Aggravated Assault, one counts of O.C.G.A. 16-5-70 Cruelty to Children in 2nd Degree and two counts of O.C.G.A 16-5-70 Cruelty to Children 3rd Degree and tendered with Terry’s criminal history document to show fact of prior history. Terry was left in the detention’s custody with no other action from the agency.

Deputy E. Garcia applied for a warrant on Terry Adam Walden and it was approved by the on-call judge. Deputy E. Garcia served Terry with the Warrant number 2025-485WA.

Deputy E. Garcia then seized Terry’s gun and the shell casing that was found as evidence. Deputy E. Garcia then transported Terry’s gun and the shell casing to the Whitfield County Sheriff’s Office for safekeeping as evidence.
