Criminal Trespass Of Property Without Permission

On October 22nd 2025, at approximately 1637 hours I responded to the Whitfield Extended Stay at [2200 BLOCK] Chattanooga Rd in reference to a male subject on the property who has been trespassed before and urinating by one of the apartment buildings.

Once on scene [WITNESS #1] informed me that the male in question was now sitting by the road and stated he has been trespassed before earlier in the year. I approached the male (Timber Peterson) and asked what was going on. He seemed to under the influence of some kind of drug, I knew it was alcohol because he did not smell of it. I noticed that his pants were wet as if he urinated on himself and asked what happened. He stated that was “at the back and I was p*ssing and a woman came up and I got scared and accidentally p*ssed on myself”.

I informed him that the caller stated he was trespassed from here and if that was the case I would be taking him to jail for Criminal Trespass. Officer Warnix arrived shortly after and I asked if he could verify that he was indeed trespassed and if this woman saw Timber expose himself. Timber was trespassed in case number (25-001847). Officer Warnix spoke with the woman [WITNESS #2] and she stated that she was walking down the steps from her room and saw that Timber was urinating with his pants down, completely exposed.

I instructed Timber to stand up and to place his hands behind his back and placed him in hand cuffs. During this Timber struggled to keep his balance. I an Officer Warnix escorted Timber to the front of my patrol car and searched him incident to arrest. No contraband was found. We then secured him in the back seat and seat belted him in.

I then transported Timber the jail and escorted him to the booking area. The booking staff had a nurse come and check Timber and stated that due to his state and his admission to taking a xanax bar and smoking several blunts they would not be taking him in.

I then transported Timber to the hospital and instructed him to be checked out by a doctor and once he finished to either turn himself in or call the non-emergency number so that he could be taken to jail. I informed him that I will be applying for a warrant for the charges of Criminal Trespass and Public Indecency.

At around 1840 hours I applied for warrants on Timber Peterson on the charges of Public Indecency and Criminal Trespass. At 1900 hours my warrants (635WA Public Indecency 16-6-8) and (636WA Criminal Trespass 16-7-21) on Timber Peterson were accepted by a magistrate judge.
