On 12/12/2024, at approximately 0720 hours, I was requested by a Baldwin County deputy to assist with a traffic stop on a black Lexus. The traffic stop occurred on Georgia Highway 29 in the area of mile marker 8 in Baldwin County. Deputy Harker advised me that he was dispatched to assist with a Wilkinson County Deputy that stopped the black Lexus at approximately 0656 hours on his way to training. The deputy that made the initial traffic stop was deputy Joe Kump with the Wilkinson County Sheriff’s Office.
I spoke with deputy Kump regarding the traffic stop. Deputy Kump told me that he observed the black Lexus driving without their headlights activated in the dark. His observation was made prior to 30 minutes before sunrise in the area of Georgia Highway 29 and Allen Memorial Drive in Baldwin County. The deputy stated that a few moments later, the Lexus passed him in the adjacent lane traveling approximately 80MPH in a posted 55MPH zone and almost crashed into the front of his patrol car. The deputy stated that when they passed the intersection of Georgia Highway 22 and Georgia Highway 49, the Lexus passed traffic improperly by utilizing the turn lane nearly striking other vehicles. Deputy Kump advised me that he initiated a traffic stop due to the driver of the Lexus endangering others on the roadway. The deputy stated the after the Lexus stopped, the driver jumped out of his car and approached the front of deputy Kump’s patrol car. Deputy Kump stated that the driver leaned over the hood of the patrol car. Deputy Kump stated that he observed the Lexus continue to roll down the shoulder of the roadway. The driver had left the car in gear and failed to put it in park. The driver of the Lexus got back in his car and drove away. The deputy stated that the Lexus stopped on Georgia Highway 29 in the area of mile marker 8. That is when the deputy called for a local agency.
Deputy Harker advised me that he asked the driver for his driver’s license 6 or 7 times but was unable to provide it. I made contact with the driver of the vehicle. He was later identified by his Georgia Driver’s License as Christopher John Matthew Dixon. I observed that Mr. Dixon had bloodshot eyes and that his pupils were constricted. The first thing that Mr. Dixon said to me was that he smoked a black and mild. He then went into talking to me about the name he wrote on his left arm. I asked Mr. Dixon to step to the front of my patrol car. Mr. Dixon asked me if I wanted coffee while walking to my patrol car. He then stated that he had a Monster in the fridge. At this point, I noticed that Mr. Dixon’s thoughts were all over the place. He could not concentrate on one topic. I asked Mr. Dixon what he had taken other than the black and mild. Mr. Dixon responded, “There’s a black and mild on my step at my house.” He then stated, “I don’t know what’s in it.” He then took the opportunity to thank us for letting him take a moment to sleep.
I asked Mr. Dixon when the last time he had something to drink was. He stated that he did not drink. I asked Mr. Dixon about medications. Mr. Dixon told me that he took sleeping medications and allergy pills. After telling me that, Mr. Dixon stated that there was a bunch of stuff in his car that he didn’t know about, and that his dog loved him. I tried to bring the topic back to the sleeping medication. I asked Mr. Dixon what kind of sleeping medication he takes. He stated, “Nothing prescribed”. I asked where he got the sleeping medication. He stated, “It was in my dresser.” I asked Mr. Dixon who it was prescribed to, and he told me that he did not know. I asked him about taking medications that were not prescribed to him. Mr. Dixon stated that he didn’t take medications. I told Mr. Dixon that he had just told me he did. Mr. Dixon looked at deputy Harker in disbelief.
I asked Mr. Dixon if he would submit to field sobriety tests. He told me that I could take his blood. I told him that I just wanted to check to see if he was safe to drive. He agreed and was medically cleared. During the Horizontal Gaze Nystagmus Evaluation, I was unable to observe any clues due to Mr. Dixon constantly turning his head after being instructed not to. He said he understood my instructions. Mr. Dixon stated that he could not do that at the same time. I asked Mr. Dixon to explain. He stated that he could not drive after having no sleep. I asked Mr. Dixon what time he woke up. He stated, “15 minutes ago”. Knowing the approximate time that deputy Kump observed the initial traffic violation, I knew that it had been approximately 40 minutes from the time Mr. Dixon was seen driving. Mr. Dixon’s attention span was short. He would change topics quickly and was easily distracted by other thoughts. I asked Mr. Dixon if he had ever experimented with any other drugs. He told me that he had with weed. I asked when the last time he had smoked weed was. He stated, “You know better than I do.” He instantly asked what my favorite number was.
I moved my patrol car to give us ample room for the Walk and Turn Evaluation. Mr. Dixon turned around after I moved it and asked how I did that. When he turned around, Mr. Dixon kicked his leg up to catch his balance. I attempted to explain the Walk and Turn Evaluation. I explained the instructions and demonstrated multiple times. Mr. Dixon stated that he understood. I was able to get through the instructional phase before Mr. Dixon started. During the Walk and Turn Evaluation, I observed 2 out of 8 possible clues before he stopped. He was unable to maintain his balance and started too soon. We did not attempt the One Leg Stand due to Mr. Dixon being uncooperative and his lack of understanding. I preformed the Lack of Convergence Evaluation. While bringing my finger to the bridge of Mr. Dixon’s nose, he started sniffing it. I observed that Mr. Dixon had a lack of convergence in his right eye. I attempted to do Modified Romberg Evaluation; Mr. Dixon was unable to do it. Many of Mr. Dixon’s responses were not the appropriate responses for the questions being asked.
I placed Mr. Dixon under arrest and in handcuffs for DUI. I asked Mr. Dixon how old he was. He replied, “Green, I’m green.” Mr. Dixon said he was 42 when the birth date that he gave me made him 41 years old. I read to Mr. Dixon Georgia’s Implied Consent Notice for subjects 21 and over from my green card and requested blood. Mr. Dixon agreed. I placed him in the rear seat of my patrol car.
Mr. Dixon was transported to Atrium Health in Baldwin for a blood draw. On the way to the hospital, Mr. Dixon continued to talk in the backseat and changed topics many times throughout the ride. He talked about names, zip codes, railroad tracks, traffic lights, sleeping with his mom or at her house, etc. Once at the hospital, Mr. Dixon had to sign some paperwork for the hospital using a digital pen and pad. Once he signed, he did not want to give the nurse back the pad and pen at first until we ordered him to. Once Mr. Dixon saw the needle, he refused the blood draw at approximately 0848 hours.
Mr. Dixon was transported to the Baldwin County Sheriff’s Office. Once at the Sheriff’s Office, Mr. Dixon was released to jail personnel with his copies of his citations, tow receipt, and 1205, which he crumbled up into a ball of paper once he received it.
