On 01/31/2023 at approximately 2037 hours, I was dispatched to Bostick Nursing Center, 1700 Bostick Circle, and made contact with Officer Roberson in reference to an assault against a person.
Officer Roberson stated a male nurse, later known as James Brown, flipped a male subject, later known as [VICTIM #1], out of his wheelchair. Officer Roberson escorted me to Unit S to speak with [VICTIM #1] in private.
When I made contact with [VICTIM #1], I noticed he had a bruise on his left shoulder and laceration on his right hand. [VICTIM #1] used a tablet to speak due to being unable to talk correctly. [VICTIM #1] stated while he was heading towards his room, he noticed Brown walking down the hallway. [VICTIM #1] stated after he waved at Brown, Brown said “fu*k you.” [VICTIM #1] advised he replied back to Brown by “fu*k back”, then stated Brown told him, “fu*k your mother.”
[VICTIM #1] stated while he was in his room, he thought about what Brown said and went to the front desk of Unit 7 to call his social worker. [VICTIM #1] stated when he saw Brown at the desk, he got upset and threw the phone at him and missed. [VICTIM #1] advised Brown walked around the desk and flipped [VICTIM #1] out of his wheelchair and stomped on his arm. [VICTIM #1] stated Brown was about to stomp him on his head, but was stopped by another patient, [WITNESS #1]. Brown advised he wanted to press charges against Brown.
I made contact with [WITNESS #1] who stated while [VICTIM #1] was on the phone, Brown had said something to [VICTIM #1] that made him throw the phone at Brown. [WITNESS #1] stated he attempted to keep [VICTIM #1] and Brown separated from each other, but Brown got around him and pushed [VICTIM #1] into the corner and flipped him out of his wheelchair. [WITNESS #1] stated Brown was hitting [VICTIM #1] with closed fists, elbows, knees, and his feet to kick him.
[WITNESS #1] stated he was able to get between the males and grabbed Brown to calm him down. [WITNESS #1] stated when Brown was about to walk away, [VICTIM #1] grabbed Brown by the ankle to pull him back. [WITNESS #1] stated he put his knee onto [VICTIM #1] to keep him pinned down and would push Brown by his knee to keep him from stomping on [VICTIM #1]. I observed blood on [WITNESS #1]’s left pants leg where he was trying to hold [VICTIM #1] on the ground.
I made contact with [WITNESS #2] in the security office who stated the incident started during the shift change at 1900 hours. [WITNESS #2] stated she only knew about the physical altercation, and advised [VICTIM #1] came down the hallway yelling at Brown. [WITNESS #2] advised [VICTIM #1] was not trying to use the phone, but he threw the phone at Brown. [WITNESS #2] stated Brown came from behind the desk and flipped [VICTIM #1] out of the wheelchair by reaching down and grabbed the bottom of the chair. [WITNESS #2] stated she did not see Brown hit [VICTIM #1] due to trying to stop another patient from joining in the altercation.
Before I spoke with Brown, Officer Roberson gave consent for me to look at the camera footage. I observed the incident at the nurse’s desk occurred at 1920 hours, and [VICTIM #1] came around the corner yelling at Brown. Once [VICTIM #1] got to the desk, he picked up the phone and put it back on the receiver. [VICTIM #1] picked the phone up again and slammed it down in the direction of Brown.
I observed Brown getting up out of his chair and [VICTIM #1] pushing himself into the left-hand side of the desk. Brown kicked a chair out of his way and flipped [VICTIM #1] out of his wheelchair by grabbing for [VICTIM #1]’s feet and pulling up. I observed [WITNESS #1] and other patient’s gather around them, and [WITNESS #1] was trying to get between the two males. I observed Brown striking the victim with a closed fist, and I observed Brown raise one of his legs up as if he was about to stomp on [VICTIM #1].
I made contact with Brown who stated ever since he started working there, [VICTIM #1] would call him a “n*gga” repeatedly with his tablet. Brown stated [VICTIM #1] came to the desk in his wheelchair yelling and pointing at him. Brown stated he tried to ignore [VICTIM #1] and turned away from him. Brown stated [VICTIM #1] had picked up the phone and threw it at him. Brown stated he reacted to the phone being thrown at him by getting up out of his chair and flipped [VICTIM #1] out of his wheelchair. Brown stated after he flipped [VICTIM #1] out his wheelchair, he left the scene.
Brown was arrested and placed in handcuffs, per departmental policy, and was transported to the Baldwin County LEC. Charges for Battery will be taken out against Brown. Photos of [VICTIM #1]’s injuries were added to the call. Camera footage of the incident will be collected on a later work date.
