On April 24th 2026, around 11:24pm, Major Boyer advised he was behind a pickup truck traveling south on South Elbert Street and the vehicle was failing to maintain a single lane of travel. Maj Boyer advised the vehicle had gone into the opposite lane of travel several times. Officer Smith and I were at the intersection of South Elbert and Vinson Highway and Maj Boyer advised he was going to wait until he was closer to us to initiate a traffic stop on the vehicle.
Maj Boyer initiated a traffic stop, and I made contact with the driver, James Liggins. While speaking with Liggins I could smell the odor of an alcoholic beverage emitting from the passenger compartment. I asked Liggins if he had been drinking and he stated earlier in the evening he had a shot and a few beers. I asked Liggins around what time did he had the drinks and he stated around 7:00pm. I asked Liggins to step out to which he did. I began medically qualifying Liggins for Standardized field Sobriety. Liggins stated he took medication for dizziness and he had problems with his knees due to roofing for 40 years. Liggins stated other than that he did not have any issues.
The first evaluation administered was the Horizontal Gaze Nystagmus. During this evaluation Liggins would not focus on the stimulus. Liggins also stated he was getting dizzy due to the evaluation. I did observe 4 of 6 clues. I did not observe Vertical Gaze Nystagmus.
Due to Liggins stating he had issues with his knees I did not ask Liggins to perform the rest of Standardized Field Sobriety.
Liggins was asked to provide a breath sample to a Portable Breath Tester. Liggins agreed. The sample provided gave a result of 0.127 Breath Alcohol Concentration (BrAC).
Liggins was read the Georgia Implied Consent Notice for Suspects Over the Age of 21 and agreed to the states test of his breath. Liggins was transported to the Baldwin County jail. The test was conducted of a certified Intoxilyzer 9000 and the results were 0.136BrAC.
Liggins was booked on a citation of Driving Under the Influence.
