I made contact with the complainant, [WITNESS #1], at Dollar General in reference to an elderly white male, later identified as Joseph Brogdon, urinating in a trash can inside the location.
[WITNESS #1] stated Joseph came into the location initially for shopping purposes, but while he was in there, requested to use the public restroom (which was locked at the time). [WITNESS #1] stated she told Joseph the restroom was out of order, and that the employee restroom was closed to the public. [WITNESS #1] stated after a few moments, one of her employees noticed Joseph was urinating in a trash can located outside of the restroom, and informed her of the incident. After Joseph finished urinating, he left the location. During the time Joseph was urinating, customers were inside the location, and were able to see Joseph urinating. Those customers included children, all of whom were visible on the surveillance video inside the store. [WITNESS #1] stated she wished to have Joseph trespassed from the location as well as have charges pressed against him.
Joseph was later located at Dairy Queen, 1105 South Wayne Street.
Joseph stated he has issues with his prostate, so at the time of the incident, he was having an emergency that came out of nowhere. Joseph stated he tried to explain to [WITNESS #1] that he did not wish to soil himself on the floor of the store, which is why when he thought no one was nearby, he used the opportunity to urinate in the trash can. I explained to Joseph that I understood his reasoning behind why he did what he did. I also informed him had he not done so in front of other customers and their children, he would have only been trespassed from the location. Due to his medical condition, Joseph was not arrested on scene but instead allowed to turn himself in to the sheriff’s office the following day on a misdemeanor public indecency warrant.
On 12/02/2024, Joseph turned himself in as previously agreed upon for his warrant without incident.
