[NARRATIVE #1 on August 05, 2026]

On August 5, 2026, at approximately 1620 hours, I responded Code 3 to the vicinity of Mulberry Road and Chicken Lyle Road in reference to a single-vehicle motor vehicle accident.

Upon my arrival, I observed other deputies speaking with the driver of a Honda Civic, who was later identified as Anthony Nolan. While deputies were speaking with Mr. Nolan, I made contact with Mr. [WITNESS #1], who identified himself as a witness to the collision.

Mr. [WITNESS #1] stated that he was photographing construction work recently completed by his crew on Mulberry Road when he heard a vehicle leave the roadway followed immediately by the sound of a collision. Mr. [WITNESS #1] stated he observed the Honda Civic traveling westbound on Mulberry Road when it exited the right side of the roadway, traveled up an embankment, struck a tree, and rotated over its roof before coming to a final rest on its tires. Mr. [WITNESS #1] stated that, after the collision, the driver backed the vehicle away from the crash scene and drove eastbound on Mulberry Road. Mr. [WITNESS #1] advised that he immediately entered his own vehicle and followed the Honda Civic until it turned into a nearby driveway. While following the vehicle, Mr. [WITNESS #1] called 911 to report the collision and provided responding deputies with the vehicle’s location.

I then made contact with Mr. [WITNESS #2], who also identified himself as a witness. Mr. [WITNESS #2] stated that he was inside his residence when he heard the sound of the collision. He advised that he exited his residence and observed the Honda Civic traveling eastbound on Mulberry Road away from the crash scene. Mr. [WITNESS #2] stated that he entered his vehicle and followed the Honda Civic until it turned into the same driveway identified by Mr. [WITNESS #1]. Mr. [WITNESS #2] advised that he spoke with the driver after the vehicle stopped. According to Mr. [WITNESS #2], the driver stated that he had been drinking and was drunk. Mr. [WITNESS #2] further stated that the driver asked him to take him home.

Both witnesses remained on scene and provided statements regarding their observations of the collision and the driver’s actions immediately afterward.

I then measured the distance from the point of impact to the driveway in which Mr. Nolan had driven after the collision. The distance was .77 mile.

[NARRATIVE #2 on August 05, 2026]

On 08/05/2026 at approximately 1615 hours, I was dispatched to the area of Mulberry Rd and Chicken Lyle Rd regarding a single-vehicle collision involving a vehicle that fled the scene. I responded to the area code three.

Upon arrival at the area, I was flagged down by a construction crew who advised me that the vehicle left the scene of the accident and was currently parked in the driveway of [100 BLOCK] Chicken Lyle Rd. I drove to [100 BLOCK] Chicken Lyle Rd and observed a gray Honda Civic bearing GA tag [REDACTED] with significant damage all around parked in the driveway of the residence. I also observed the driver of the vehicle, later identified as Anthony Nolen, sitting on a chair on the front porch of the residence. Anthony had blood in several different parts of his body and was wet with dirt all over his clothing.

I then spoke to Anthony and asked him if he had been drinking, and he stated that he had been drinking a little bit. I asked Anthony what happened, and he stated that I didn’t see him driving, and he had been at this residence all night with his friend. Anthony stated that he was having a really bad day because he broke up with his girl and was coming from his house right up the street. Anthony eventually admitted to driving off the roadway and added that he was not wearing a seat belt at the time. While speaking to Anthony, I smelled the strong odor of an alcoholic beverage coming from his breath, and observed that his speech was slurred, and his eyes were bloodshot and glassy.

I asked Anthony if he was willing to participate in field sobriety exercises to determine if he was okay to drive, and he stated that he was not okay to drive. I asked him again if he would consent to performing field sobriety exercises, and he agreed. I asked Anthony if he had any medical conditions that would prevent him from standing, walking, or turning, and he stated no. I asked Anthony if he was wearing eye contacts, and he stated that he was not.

I told Anthony to stand with his feet together and his hands down at his side. I told Anthony to stay in that position while I explained what he needed to do. I asked Anthony to look forward and not move his head. I told Anthony to follow the tip of my pen with his eyes only. I asked Anthony if he understood, and he stated that he did. I checked for equal pupil size and detected it. I checked for resting nystagmus but did not detect it. I checked for equal tracking and detected it. I checked for lack of smooth pursuit and detected it in both eyes. I checked for distinct and sustained nystagmus at maximum deviation and detected it. I checked for the angle of onset of nystagmus and detected it. I checked for vertical nystagmus and detected it. I observed 6 out of 6 clues.

I told Anthony to stay in that position and told him I was going to circle his face with my pen. I told him to follow the pen with both eyes. I told Anthony that I would bring it towards his nose, and he was to follow it with both eyes. I told Anthony that if he needed to cross his eyes, that was okay. I asked Anthony if he understood, and he stated that he did.

I checked for lack of convergence and detected it. Neither eye would come to center. I told Anthony to stand with his feet together and his hands down at his side. I told Anthony to stay in that position while I explained what he needed to do. I told Anthony that when instructed, he was to lean his head back and close his eyes. I told Anthony that when I told him to begin, he was to estimate the passage of 30 seconds. I told Anthony that when he thought 30 seconds had elapsed, he had to open his eyes and say stop. I asked Anthony if he understood, and he stated that he did. I told Anthony to lean his head back and close his eyes. I told him to begin. Anthony estimated 30 seconds in 50 actual seconds. I observed that Anthony had body tremors, eyelid tremors, and a sway.

I showed Anthony a straight line and asked him to place his left foot on it. I told Anthony to place his right foot in front of it, heel-to-toe. I told Anthony to keep his hands at his side and demonstrated. I told Anthony to stand in that position while I demonstrated the nine-step walk-and-turn evaluation and not to begin until told to do so. I asked if he understood, and he stated that he did. I attempted to demonstrate the exercise to Anthony. In the process of demonstrating, Anthony began walking without being told to do so and eventually stated that he did not want to continue with field sobriety exercises. During the instructional phase. Anthony lost balance and was told to get back in position multiple times. I observed 2 out of 8 clues.

I retrieved a portable breath tester, and Anthony refused to provide a breath sample. Based on the totality of the circumstances, I decided to place Anthony under arrest. I told Anthony that he was under arrest and read him the Implied Consent notice for individuals aged 21 and over and asked if he would take the state-administered breath test. Anthony refused by remaining silent. I explained to Antony that not providing an answer constitutes a refusal. I again read the Implied Consent notice for individuals over the age of 21 and asked if he would take the state-administered blood test. Antony refused by stating no.

After EMS personnel spoke to Anthony, he refused to be transported for further treatment. I then secured Anthony in a set of handcuffs behind his back, which were double locked and checked for proper fit. I then secured Anthony in the back seat of my patrol vehicle and fastened the seatbelt. Because the accident occurred at a different location, Deputy Jackson conducted an on-scene accident investigation and spoke to the witnesses to the crash. I transported Anthony to the Northeast Georgia Barrow Hospital for jail clearance. While in the hospital, I served Anthony with a 1205 form, which he signed. I was unable to take possession of Anthony’s driver’s license because he did not have it on his person while driving his motor vehicle. Anthony was eventually cleared by medical staff and was transported to the Barrow County Detention Center by Deputy Wilkins, where he was turned over to Detention Staff without further incident.
