On 07/17/2026 at approximately 1303, Deputy McCurry requested my assistance with conducting a D.U.I investigation. I responded to the area code three. Upon arrival, I met with Deputy McCurry. McCurry stated that the driver, later identified as Ashley Summer, almost hit him while traveling on University Parkway near its intersection with Carl-Bethlehem Rd.
McCurry stated that Ashley denied drinking alcohol, but he smelled it inside the vehicle she was operating. McCurry requested that I assist him with conducting field sobriety exercises to determine if Ashley was okay to drive. I spoke to Ashley. I asked her how much she had to drink, and she stated that she had only one Natural Light beer. I asked Ashley where she was coming from, and she stated that she was traveling from South Carolina and was on her way to visit a friend in Bethlehem.
I asked Ashley if she had any open containers in the vehicle, and she stated that she had a Natural Light in one of the cup holders along with water in her Georgia cup. McCurry advised me he found two beer cans in the cup holders that were still cold to the touch, which he sat down on the hood of his patrol vehicle. I asked Ashley if she was willing to participate in field sobriety exercises to determine if she was okay to drive, and she agreed. Ashley stated that she was nervous and wasn’t able to perform walking exercises, but I could check her eyes.
I asked Ashley if she had any medical conditions that would prevent her from standing, walking, or turning, and she stated that she had none. I asked Ashley if she was wearing eye contacts, and she stated that she was not. I told Ashley to stand with her feet together and her hands down at her side. I told Ashley to stay in that position while I explained what she needed to do. I asked ASHLEY to look forward and not move her head. I told Ashley to follow the tip of my pen with her eyes only. I asked Ashley if she understood, and she stated that she did.
I checked for equal pupil size and detected it. I checked for resting nystagmus but did not detect it. I checked for equal tracking and detected it. I checked for lack of smooth pursuit and detected it in both eyes. I checked for distinct and sustained nystagmus at maximum deviation and detected it in both eyes. I checked for the angle of onset of nystagmus and detected it in both eyes. I checked for vertical nystagmus and did not detect it. I observed 6 out of 6 clues.
I told Ashley to stay in that position and told her I was going to circle her face with my pen. I told her to follow the pen with both eyes. I told Ashley that I would bring it towards her nose, and she was to follow it with both eyes. I told Ashley that if she needed to cross her eyes, that was okay. I asked Ashley if she understood, and she stated that she did.
I checked for lack of convergence and detected it. Neither eye would come to center. I told Ashley to stand with her feet together and her hands down at her side. I told Ashley to stay in that position while I explained what she needed to do. I told Ashley that when instructed, she was to lean her head back and close her eyes. I told Ashley that when I told her to begin, she was to estimate the passage of 30 seconds in her mind. I told Ashley that when she thought 30 seconds had elapsed, she had to open her eyes and say stop. I asked Ashley if she understood, and she stated that she did. I told Ashley to lean her head back and close her eyes. I told her to begin.
Ashley estimated 30 seconds in 30 actual seconds. I observed that Ashley had eyelid tremors, body tremors, and a sway. I asked Ashley if she wished to continue performing exercises, and she refused by stating, “No, why would I” I retrieved a portable breath tester, and Ashley provided a breath sample that was positive for the presence of alcohol (BAC .251%) I then gave Ashley another opportunity to tell me how much she really had to drink. Ashley stated she had one and a half beers and, while pointing at the beer cans, stated: “I would like to finish it actually”.
I placed Ashley under arrest in a set of handcuffs on the front of her body, which I double locked and checked for proper fit. I told Ashley she was under arrest. I then read Ashley the Implied Consent notice for individuals aged 21 or over and asked if she would take the state-administered breath test. Ashley refused by stating no. I again read Ashley the Implied Consent notice for individuals aged 21 or over and asked if she would take the state-administered blood test. Ashley refused by stating no.
I secured Ashley in the backseat of my patrol vehicle and fastened the seatbelt. I transported Ashley to the Barrow County Detention Center, where she was turned over to Detention staff without further incident. The back seat of my patrol vehicle was searched before and after transport with no contraband located. Deputy McCurry requested a next list wrecker to remove Ashley’s vehicle from the scene. McCurry completed a vehicle inventory, and H&H wrecker eventually took possession of the vehicle without further incident.
I cited Ashley for the following violations.
MCE035527 DUI.
MCE035528 Reckless driving.
MCE035529 Failure to yield.
MCE035530 Improper backing
MCE035531 Open container.
I completed a Form 1205 and explained it to Ashley. She signed it, and I placed a copy with her property along with a copy of the citations. The original court copies of the citations were dropped in the citation box located in the pre-booking area of the Detention Center.
The Form 1205, along with Ashley’s driver’s license, was turned in at the Barrow County Sheriff’s Office for processing.
