On 7/3/2026 Deputy Antwune McCurry was dispatched to Bethel Bower Road regarding a motor vehicle crash. While enroute it was relayed that the male driver had fled the scene of accident and was seen at a nearby convenience store.

Upon my arrival at the accident scene, I contacted a witness on scene who was identified to be [WITNESS #1]. He stated that the driver of the vehicle was his brother Cyrus Jackson.

[WITNESS #1] went on to state he was just in the area and observed the vehicle wrecked unoccupied and returned to check the welfare of his brother due to him experiencing some recent mental, emotional, and substance abuse issues.

I then begin the crash investigation, determining that the driver of the vehicle fails to maintain his travel lane before leaving the roadway colliding with a ditch.

Assisting Depuy Arango contacted Cyrus inside a local Chevron gas station and escorted him back to the scene of accident.

During this encounter I immediately observed Cyrus to have bloodshot watery eyes, with the strong odor of an alcoholic beverage emitting from his breath. I spoke to him about the accident and consumption of alcohol. He stated he drank five days prior to this date; I continuously observed him displaying drunken like behavior such as: Stumbling around, reaching for patrol vehicle for support, thick slurred speech, and seemed very disoriented.

After Cyrus continued displaying signs of impairment I asked him if he would perform a field sobriety testing to see if he could safely operate a motor vehicle. Which he verbally agreed to with a mumble and head nod. The first field sobriety test Cyrus completed was the Horizontal Gaze Nystagmus (HGN). First, I checked for equal tracking and equal pupil size in both eyes which was observed. I then checked for 1) Lack of Smooth Pursuit. 2)Distinct Sustained Nystagmus at Maximum Deviation.3) Onset of Nystagmus prior to 45 degrees which was observed in both eyes. No vertical Nystagmus was present

The Next field sobriety test I had Cyrus complete was Walk and Turn (WAT). During the testing he was observed 1) failing to balance during instructional stage, 2) Starting too soon 3) Missing heel-to-toe, 4) Stepping off the line 5) Using arms for balance. 6) Stops while walking to balance himself. 7) turned improperly. 8) incorrect number of steps.

Lastly, I had Cyrus attempt to complete the One Leg Stand (OLS). During this testing I had to continuously repeat the directions. He was observed Swaying, raising his arms, and stumbling around being very unsteady to his feet. After several attempts he terminated the testing.

I then asked Cyrus if he would consent to a breath sample on my portable alco sensor. He begins rambling in conversation, acting dazed and confused. He then refused the breath sample.

Based on my training and experience, totality of circumstances, accident, initial contact, and field sobriety testing lead me to believe Cyrus was to be impaired to be operating a motor vehicle. He was then placed under arrest. I cuffed him to the rear. Cuffs were then double locked and fitted for tightness.

I read to him from Georgia Implied Consent notice for suspects 21yrs older requesting a breath sample. He then verbally refused the state administered testing. I then re-read him Georgia Implied consent notice for suspects 21 yrs older requesting a blood sample which he also refused.

I safely secured Cyrus in the rear of my patrol vehicle. Vehicle was later released to next list wrecker service All around towing.

The offender was then transported by Deputy Arango to Northeast Georgia Barrow for medical clearance due to being involved in a motor vehicle accident. Once offender received medical clearance, he was then transported to Barrow County Detention Center.

Once at the detention center Cyrus was citied and served with citations for the following charges:

Dui-less safe 40-6-391 A (1), 2) Failure to maintain lane 40-6-48. 3) Hit& Run leaving the scene of an accident. However, offender was also served with a Georgia DPS 1205 form.

Offender was then released to staff for further processing.
