On 8/29/26 Deputy Antwune McCurry was dispatched to Jefferson Highway regarding a hit and run. Upon arrival I contacted vehicle #2 and retrieved all information including a vehicle description of the vehicle which fled the scene and damages.
During the accident investigation it was determined suspect vehicles were driving in a reckless manner in disregard for the safety of others, while failing to maintain his lane of travel colliding with the rear end of vehicle #2. Officers later contacted a black in color Ford f-150 barring registration plates [REDACTED]. Officers observed the vehicle to be warm to touch and recent, mud, and debris displayed on the vehicle with right passenger front damage that was consistent with vehicle #2 with paint transfer that was parked at a camper next to a shop at a dead-end driveway.
While on scene officer contacted the vehicle owner who was identified to be Devan Micheal Williams. During this encounter I spoke with Devan about being involved in an accident recently and leaving the scene. He immediately denied and acted dumbed founded. While speaking with him I observed him having bloodshot, watery eyes with the strong odor of alcohol emitting from his breath with a thick slurred speech.
I asked him to accompany me at the vehicle to access damages to the vehicle. He became argumentative. As the conversation ensued, I escorted him to the end of the porch observing him to be unsteady to his feet, walking in a staggering motion, sweating profusely, and extremely sluggish. We continued speaking about the accident and he denied and stated that he had been asleep all morning and the vehicle hadn’t left the driveway since (7am) this date. I then asked about Micheal consuming alcohol which he verbally admitted to consuming. I asked him if he would consent to a field sobriety test along with a breath sample on my portable alco sensor. With a confused facial tone Micheal continued demonstrating drunk-like behavior such as: Fumbling around, disinterested, confused, and display droopy eyelids he declined.
Based on my training an experience, accident scene, witnesses, physical and testimonial evidence, vehicle damage, and Micheal’s behavior and demeanor lead me to believe he was less safe to operating a motor vehicle. I Placed him under arrest for Suspicion of Dui-less safe. He was cuffed to the rear. Cuffs were double locked and fitted for tightness.
I read to him Georgia Implied Consent for suspects 21 years older requesting breath sample. He then verbally refused the testing. I read him a second time requesting a blood sample, he again refused testing. I later secured Micheal in the rear of my patrol vehicle. Before clearing the scene, I contacted the property owner [REDACTED] who was able to provide camera footage of Micheal entering the property seconds after he fled the scene of the accident.
Offender was then transported NEGA Barrow for medical clearance. Once offender was cleared Micheal was transported to Barrow County Detention Center for processing.
Offender was citied and served with Traffic Charges: 1) Dui-less safe 40-6-391 (A)(1) #E037068, 2) Reckless Driving 40-6-390 #037069, 3) Hit-Run leaving scene of accident 40-6-270(A) #037070, 4) Failure to maintain lane 40-6-48 #E037071, 5) Following too Closely 40-649 (A) #037072.
As I was completing my initial report it was also brought to my attention that this was Micheal’s Second time being charged with Suspicion of Dui-less safe within approximately a one-month time period.
