On September 4th 2026, I was conducting stationary patrol in the area of Atlanta Hwy (Ga8) and Autry Road when I observed a blue Nissan Rogue Sport, Displaying Ga Tag [REDACTED], pass by me. After running the registration through GCIC, it returned stating the tag expired on 08/14/2026.

After getting behind the vehicle, I activated my emergency equipment and initiated a traffic stop in a safe area. I approached the driver, identified myself, and told him the reason for the traffic stop. I then asked for his driver’s license. He handed me an Identification Card. After asking him if he had a driver’s license, he stated they were suspended and the court took his driver’s license. The driver was identified as Mr. Diego Castillo. Due to being stopped in the middle of McDonalds parking lot, Mr. Castillo was instructed to move his vehicle to the side of the business. During the conversation with Mr. Castillo, his speech appeared to be very slow, and his eyelids droopy. I went back to my patrol vehicle and ran his information through GCIC. It returned stating that his driver’s license was suspended for serious traffic violations, under 21. It also stated that he had multiple warrants from Lawrenceville Police Department for traffic violations, and failure to appear.

Sgt. Rucker #810 arrived to assist. I approached Mr. Castillo and instructed him to exit the vehicle. Department issued handcuffs were placed on his wrists, checked for fit, and double locked for safety. He was instructed to walk to the front of my patrol vehicle where he was searched incident to arrest. As he was being searched, he was very unsteady on his feet. He was then secured in the backseat of my patrol vehicle and prepared to transport to Barrow County Jail. Due to the mannerisms Mr. Castillo had, I asked him how much marijuana was in the vehicle, and he stated there was a vape under the driver seat.

A probable cause search was conducted on the vehicle. During the search, a yellow vape pen with a thick brown liquid, suspected to be THC was found under the driver seat. After discovering the pen, I read Mr. Castillo his Miranda Warning, and he refused. He was then read his implied consent warning for suspects under the age of 21 and he agreed to a blood draw. He was transported to Barrow Medical for the blood draw. After a temporary hold-up in the hospital, due to a process change, the medical staff took the chemical sample of Mr. Castillo’s blood without incident.

He was then transported to Barrow County Jail. Dispatch was informed of my beginning and ending milage prior to and after transport. Mr. Castillo and his belongings were turned over the Barrow Jail Deputy without incident. The blood draw kit was labeled as item #01 and placed into temporary evidence refrigerator. The THC vape was labeled as item #02 and placed into an evidence bag and placed into temporary evidence locker #02. A GBI Submission form was filled out for both pieces of evidence.

O.C.G.A 40-6-391A2 (DUI Less Safe – Drugs)
O.C.G.A 16-13-30 (Poss. of Schedule I)
