On 7/30/2026 at approximately 2107 hours, I, Ofc. B. Harris W152 was dispatched to [200 BLOCK] Capitol Ave, Unit [REDACTED], Winder, GA 30680, regarding a meet-in-person. I responded CODE 1 (no lights or sirens activated) in marked patrol vehicle #400.
This call was in reference to an earlier meet-in-person on 7/30/2026 at approximately 1059 hours at the Winder Police Department (25 E Midland Ave, Winder, GA 30680). Due to all the Winder Police Officers attending a funeral, Barrow County Sheriff’s Office Deputies spoke with the caller, [VICTIM #1]. Barrow County Deputies advised Ms. [VICTIM #1] that as soon as possible, a Winder Police Officer would contact her to file the report. Ofc. A. Malesky reached out to Ms. [VICTIM #1] at approximately 1652 hours, and Ms. [VICTIM #1] stated that she was in Atlanta, picking up her son from the airport, and would be home around 9 PM. Ms. [VICTIM #1] stated she would call 911 then to have a Winder Police Officer take the report when she gets home. The original case report # was 2026-00039237.
Upon arrival, I was met at the front door by Ms. [VICTIM #1]. Ms. [VICTIM #1] stated that at approximately 2300 hours on 7/29/2026, she and her friend, [VICTIM #2], were upstairs in the shower of her residence. Ms. [VICTIM #1] stated that her ex-boyfriend, D’Mari Gates, ripped the shower curtain open and pointed a gun at her and Mr. [VICTIM #2]. Ms. [VICTIM #1] stated that Mr. Gates told her and Mr. [VICTIM #2] to give him all of their money. Ms. [VICTIM #1] stated that a scuffle ensued to try to get the gun away from Mr. Gates. Ms. [VICTIM #1] stated that during the scuffle, Mr. Gates struck her with the butt of the gun on her face, chest, and leg. I did observe a mark on Ms. [VICTIM #1]’s chin, along with multiple marks on her chest and a large bruise on her inner left thigh that looked to be very recent. I asked Ms. [VICTIM #1] what color the gun Mr. Gates used was, and she said it was black.
Ms. [VICTIM #1] stated that during the scuffle, Mr. Gates broke Mr. [VICTIM #2]’s cell phone. Ms. [VICTIM #1] then stated that Mr. Gates left the bathroom, removed a picture off the wall in her bedroom, and threw it at Ms. [VICTIM #2], causing the dark-colored picture frame to break. I asked Ms. [VICTIM #1] how much she paid for the picture, and she stated approximately $15. Ms. [VICTIM #1] stated that Mr. Gates then ran down the stairs and fled the scene.
Ms. [VICTIM #1] then stated that as Mr. Gates was leaving the residence, he stated that he was going to come back and kill her. Ms. [VICTIM #1] stated that her doorbell camera was lying on the ground outside her front door when she went outside and that Mr. Gates removed it before entering the residence and was unable to recover any video footage. Ms. [VICTIM #1] stated that she accidentally left her garage door open and the door from the garage to the inside of the residence is usually left unlocked, which is how Mr. Gates was able to enter her home. I asked Ms. [VICTIM #1] if she and Mr. Gates have ever lived together, and she said no. Ms. [VICTIM #1] stated that she was terrified throughout the incident, thinking that Mr. Gates was going to shoot her.
I then asked Ms. [VICTIM #1] if she would be willing to fill out a witness statement, and she agreed. After she completed the witness statement, I had Ms. [VICTIM #1] try to contact Mr. [VICTIM #2]. Ms. [VICTIM #1] attempted multiple phone calls to Mr. [VICTIM #2], but it kept going straight to voicemail. I advised Ms. [VICTIM #1] that another officer and I would go over to Mr. [VICTIM #2]’ residence to make contact.
Ofc. J. Bruce W137 made contact with Mr. [VICTIM #2] at his residence ([40 BLOCK] E New St, Winder, GA 30680). Upon arrival, I met with Mr. [VICTIM #2], and he stated that he and Ms. [VICTIM #1] were in the shower at her house when Ms. [VICTIM #1]’s ex-boyfriend opened the shower curtain and pointed a gun at both him and Ms. [VICTIM #1]. Mr. [VICTIM #2] stated that Mr. Gates demanded that both of them give him all of their money. Ms. [VICTIM #2] stated that a scuffle ensued and that Mr. Gates hit Ms. [VICTIM #1] multiple times with the gun. Mr. [VICTIM #2] stated that he was able to get Mr. Gates to calm down.
Mr. [VICTIM #2] then stated that Mr. Gates left the bathroom, grabbed a picture off the wall, and threw it at him, but it didn’t hit him, and then left the scene. Mr. [VICTIM #2] stated that during the scuffle, Mr. Gates broke his black Apple IPHONE. Mr. [VICTIM #2] stated that he already got the phone fixed today. I asked Mr. [VICTIM #2] how much he paid to get it fixed, and he stated $70. Mr. [VICTIM #2] stated that he didn’t know who Mr. Gates was at the time of the incident, as he had never met him. I asked Mr. [VICTIM #2] if he would be willing to fill out a witness statement, and he agreed. Mr. [VICTIM #2] also stated that he was terrified during the incident because he thought he and Ms. [VICTIM #1] were both going to be shot. Mr. [VICTIM #2] stated that he didn’t have any marks on him from the incident.
Ofc. P. Melniciuc W151 and I drove back to [200 BLOCK] Capitol Ave, Unit [REDACTED] to speak with Ms. [VICTIM #1] again. When I arrived, Ms. [VICTIM #1] stated that Mr. Gates’ sister, [VICTIM #3], was texting her. I viewed the text messages from Ms. [VICTIM #3] stating that Mr. Gates was at home, that she was scared, and wanted police officers to come to the house. I advised Ms. [VICTIM #1] not to tell Ms. [VICTIM #3] that we were on the way so as not to give Mr. Gates any reason to leave the house. I asked Ms. [VICTIM #1] why she didn’t call 911 immediately when the incident happened, and she stated that she was terrified after being hit multiple times with the gun and then proceeded to lie on her bed after Mr. Gates ran away.
Winder Units gathered together and drove to Mr. Gates’ residence at [200 BLOCK] E Wright St, Winder, GA 30680. Upon arrival, I observed a black male sitting in a chair outside the garage who matched the description of Mr. Gates. I approached Mr. Gates and told him I needed to speak with him. I asked Mr. Gates where he was last night around 11, and he stated that he was at home and never left. Mr. Gates stated that he doesn’t go anywhere and sits at home. I asked Mr. Gates if anyone at the house could corroborate his whereabouts at that time, and he stated his sister could. At that time, Ms. [VICTIM #3] walked to the front door. I asked Ms. [VICTIM #3] if Mr. Gates ever left the house last night, and she said yes. I asked Ms. [VICTIM #3] again if Mr. Gates definitely left the house last night, and she again said she heard him leave, but couldn’t remember what time. Ms. [VICTIM #3] stated that Mr. Gates gets very mad very easily.
I walked back around to the garage and told Mr. Gates that he already lied to me once about not leaving the house last night, because his sister just told me she heard him leave. Mr. Gates seemed surprised after hearing that. I then asked Mr. Gates one more time where he had been last night, and he said, “I was chillin’.” After hearing all the testimonial evidence and viewing the physical evidence, I had probable cause to arrest Mr. Gates. I then advised Mr. Gates to stand up and place his hands behind his back. Mr. Gates then told me that he had his firearm in his waistband. I removed the firearm from his waistband, which was inside of a black holster. The firearm was a black Glock 43X 9MM handgun (Serial #BPYH029) with a loaded 10-round magazine. I then turned Mr. Gates around and placed him in properly spaced, double-locked handcuffs behind his back.
I then searched Mr. Gates’ person for other weapons, contraband, and means of escape with negative findings. I then walked Mr. Gates to my patrol car, where I placed him in the rear passenger compartment and secured him using a lap-and-shoulder harness for his safety. The black Glock 43X 9MM handgun (Serial #BPYH029) and holster were placed in my patrol vehicle to be placed into evidence.
I then transported Mr. Gates to the Barrow County Detention Center, where he was released from my custody to the Detention Center staff without further incident. I checked the backseat of my patrol vehicle before transporting Mr. Gates and after dropping him off at the Detention Center with negative findings. The arrest booking and victim notifications were completed at the Detention Center. I then drove back to [200 BLOCK] E Wright St as Ms. [VICTIM #3] stated she would complete a witness statement, which she did.
I then drove to the Winder Police Department (25 E Midland Ave, Winder, GA 30680), where the black Glock 43X 9MM handgun (Serial #BPYH029), a 10-round-capacity magazine, 10 rounds of 9MM Luger ammunition, and a black holster were placed into evidence temp locker #007. Photos of the injuries to Ms. [VICTIM #1] and damage to the picture frame have been attached to the report along with the witness statements.
