On 6/20/2026 While on patrol of Highway 211 NW I Deputy Antwune McCurry Observed the following vehicle to display a spider cracked windshield which obstructed the driver’s view along with displaying rear window glazing that appeared darker than the state’s legal limit of (32%).
I positioned my patrol unit behind the vehicle and activated my emergency equipment and initiated a traffic stop on the vehicle. Upon exiting my vehicle using a passenger side approach I contacted the male driver. I briefly explained the traffic violation and requested some form of identification. While speaking with the driver I immediately having a dazed appearance, with him breathing heavily, and shaking profusely as he provided me with a Georgia license which identified him to be Enrique Antonio Beher.
I relocated myself to the driver’s side of the vehicle and continued speaking with him observing him to have a thick slurred speech. I asked him to exit the vehicle and accompany me to the rear. While outside the vehicle Enrique I could smell the odor of an alcoholic beverage emitting from his breath, as he continuosly fumbled around, with a nervous tick, while scratching his head, rubbing his head, and staring off in a distance having a difficult time focusing continuously staring back to his vehicle.
Based on my training experience, and behavior I was observing, Enrique led me to believe criminal activity was occurring inside the vehicle. I asked him about any weapons or illegal contraband being present inside the vehicle along with asking for consent to search. He immediately became hesitant and began stuttering before refusing to search for consent, with sweat beading from forehead and continuously rubbing fingers through his hair and requesting a cigarette from the vehicle.
I then requested assistance from a local K-9 for assistance. Based on Enrique display signs of impairment I asked him if he would perform field sobriety testing. He then agreed to the testing. The first field sobriety test I had Enrique complete was the Horizontal Gaze Nystagmus. First, I checked for equal pupil size and equal tracking in both eyes which I observed. Next, I checked for Lack of smooth pursuit, Distinct & Sustained Nystagmus at maximum deviation, and onset of Nystagmus prior to 45 Degrees which was observed in both eyes.
However, I observed eyelid tremors, and pupils to be dilated. The next field sobriety test, I had Enrique complete was the Walk and Turn (WAT). During the testing I had to explain instruction several times he was then observed: (1) Failing to balance during instruction stage, (2) Starts too soon (3) Stops while walking, (4) Misses heel-to-toe, (5) Steps off the line, (6) Uses arms for balance, (7) Improper turn (8) Taking the incorrect number of steps.
Last, I had him perform the One Leg Stand. I explained the instructions and he terminated the testing. Once field sobriety testing was complete, I asked him if he would submit a breath sample on my portable alco sensor. He declined to provide a breath sample on my portable alco sensor. During this time Officer Hunter Cureington with Winder Police Department and his K-9 partner were on scene for a free air sniff of the vehicle which he later informed me his partner gave a positive alert.
A probable cause of the vehicle was then conducted. During the search officers located (3) partially empty plastic bottles which contained suspected Pinnacle Vodka, (1) [REDACTED BY AGENCY] which contained a large white crystal of a crystallized substance suspected to be methamphetamine, digital weighing scale, and glass smoking pipe.
I then placed Enrique under arrest. He was cuffed to the rear. Cuffs were double locked and fitted for tightness. I read to him from the Georgia Implied consent Card for suspects 21years older requesting a blood sample. He then verbally agreed to the state administered testing and was secured in the rear of my patrol vehicle. As he was secured in the rear he admitted to being on felony probation from another jurisdiction (Gwinnett).
A family friend responded to the scene who was identified to be [REDACTED] and retrieved the vehicle. Scene was then cleared and I transported Enrique to Northeast Georgia Barrow Hospital and [REDACTED] performed the testing and sealed the state administered test box. Offender was then transported to Barrow County Detention and released to detention staff. I then secured criminal warrants for the offenses: 1) Windshield violation 40-8-73, 2) Window tint 40-8-73.1, 3) Possession of Methamphetamine 16-13-30, 4) Open Container 40-6-253, 5) Drug Related Objects 16-13-32.2, 6) Dui/less safe – combination 40-6-391(A)(4).
Back seat check was conducted before and after arrest was affected.
All evidence seized was transported to Barrow County Sheriff’s office and secured into evidence. The approximate weight of the suspected methamphetamine was approximately -+ (2 grams).
