On 05/14/2026 while on routine patrol in my marked patrol vehicle, I was conducting traffic enforcement on Atlanta Hwy SE near Pickle Simon Rd. in Barrow County, GA. I witnessed a white in color, KIA K5, bearing a Maryland license plate [REDACTED], traveling east on Atlanta Hwy SE in front of me. The vehicle was driving right behind another vehicle, tailgating and appearing impatient as it was moving around in the lane.
When the vehicles approached the airport, the driver ahead of the KIA seemed to be tired of the vehicle riding its bumper, and slowed down in the roadway. When the vehicle drove off again, the KIA then accelerated to catch back up. When coming to the curve and hillcrest near Giles Rd., the KIA passed on double yellow lines, using the oncoming lane with a vehicle coming west, swerving back over, now in front of the vehicle it had been following. There was nearly a head on collision with the vehicle heading west on Atlanta Hwy SE.
I initiated a traffic stop using my emergency lights and audible siren, which the vehicle then began to pull over, eventually stopping in the Chevron (Hardigree) gas station parking lot. I approached the driver and made contact with a female, explaining how that was a poor driving decision with an officer behind her. The female acknowledged what she had done, not seeming remorseful, as she wanted to point out the other driver braked in front of her prior. I had to explain that it was in response to her following too closely and tailgating that vehicle for a while. I requested her license and she fumbled through her bag, initially unable to locate her license. I noticed when she was speaking her speech was thick and slow. The female then remembered she needed the license, getting it along with other cards, and dropping one while fumbling.
The female was identified as Ms. Felicia Rodgers by her GA license, and I asked where she was headed. Felicia stated she was headed home, which was not far, being in Statham, GA. I asked where she was coming from and told me she was getting food, but also Doordash working. I asked if this was her vehicle and she advised it was a rental.
I returned to my vehicle to run her information through GCIC but suspected she may be impaired, grabbing my hand held alco-sensor from the approved GBI list. I returned to Felicia and advised I would like a sample, asking if she had anything to drink this date. Felicia stated yes, advising she had “a beer and a shot”. I asked how long ago it was she had drank and she stated, “an hour ago”. I asked what kind of beer and she stated “Coors Light”, then what kind of liquor and she stated, “Smirnoff”. I had also asked about medications, one of which being [REDACTED BY AGENCY]. I also asked if she used illegal drugs but she stated no. I then had her exit the vehicle to conduct field sobriety testing.
When Felicia exited the vehicle she was already telling me about the [REDACTED BY AGENCY] in her feet, stating she had poor balance, being unsteady on her feet. Felicia did appear to have issues with, but she was also swaying around and the more she spoke the more words would sound slurred. The intoxication seemed to amplify what her health issues were. I had her walk to my patrol vehicle to begin testing and noticed while speaking to her there, the odor of aloholic beverage was emitting from her breath. Felicia made sure to explain about her balance issues, which I countered with acknowledging them and telling her I would not have her perform the walking and balancing testing.
I completed an abbreviated form of SFST to prevent injury to her by losing balances or falling.

Comments: Felicia was swaying around during this testing, separating her feet to acquire better balance, but still almost falling into me. The presence of onset prior to 45 degrees is an indication of higher levels of impairment. The presence of Vertical Nystagmus is an indication of high levels of impairment for a particular individual. I also had to remind her multiple times to look at the stimuli as she would continuously look or stare at me instead of follow.

I explained how to provide a breath sample via the hand held alco-sensor, Felicia agreed to the sample, showing a positive result for the presence of alcohol. The BrAc was 0. 180 which seemed to coincide wit the results of testing I was seeing. I asked again about the amount of drinks Felicia had consumed and now it had been “two shots” and a beer. With the witnessed driving violations, demeanor, manifestations, admission to drinking, odor of alcoholic beverage, testing, she appeared to be intoxicated to an extent which was not safe for her to continue driving.
I placed Felicia under arrest in handcuffs, behind her back, checked them for fit and double locked them. I told Felicia she was under arrest for DUI. I searched Felicia incident to arrest for weapons or contraband, and seated her in the back seat of my patrol vehicle. I then read the Georgia Implied Consent Notice Suspects Age 21 or Over, word for word, from an official green in color card, and she agreed to “breath”.
I searched the vehicle for any evidence of the crime of DUI, finding no open containers, but two small bottles of Smirnoff vodka which were sealed. It was clear that Felicia was drinking and preparing to continue drinking that same brand of liquor. I did allow Felicia to make a phone call and have someone come collect the vehicle. Dep. Matherly assisted with this and stayed with the vehicle until the person she called collected the vehicle.
I buckled Felicia’s seat belt and transported her to the Barrow County Detention Center. I met with jail staff and Sgt. Kinney to complete the Implied Consent Breath test. Sgt. Kinney operated the machine and when Felicia was to give the second breath sample as required, she refused to provide the second of the two samples for the Intoxilyzer 9000. Felicia became difficult during this as Sgt. Kinney attempted to explain what would happen but she did not listen. With only having one sample it was the sample used, being 0.162 BrAc. This put Felicia over the legal limit, making it a Per Se DUI.
I issued Felicia three citations for; DUI Alcohol Per Se, Improper Passing, and Following Too Closely. I completed the DDS 1205 form, attaching her license to the DDS copy, providing her a copy (she was explained and served), and attaching a copy with the citation and Intoxilyzer results. I took a picture of the Intoxilyzer result and have attached it with this report.
The back seat of my patrol vehicle was checked prior to and after transport for weapons or contraband, nothing was found.
