On April 22, 2026, at 1107 hours, I responded code 1 to Home Depot (649 Carl-Bethlehem Rd.) in reference to a suspicious person call. The caller, [WITNESS #1], stated a male was in the parking lot naked. By the time I arrived [WITNESS #1] stated the male had put on clothes and walked into Home Depot.
[WITNESS #1] stated that when he arrived at Home Depot, he witnessed an older white male standing at the driver’s door of a BMW SUV with Georgia tag [REDACTED]. The male was completely naked standing in the open door of the BMW. [WITNESS #1] said the male began doing jumping jacks. [WITNESS #1] said he took a phone call and a minute later he looked back and the male was “humping” the driver’s seat. [WITNESS #1] said the male then got back into the BMW and put on a shirt. [WITNESS #1] was able to record the male at this point.
[WITNESS #1] provided me with the video. In the video you can see the male has his shirt on while sitting in the driver’s seat. The male is getting out of the vehicle and has no pants on and his genitals are in full view of the public. The male has pants in his hands. This is where the video ends.
[WITNESS #1] stated it was an older white male was wearing a black shirt, black jogging pants, and a hat. Last seen walking into Home Depot. Based on the video footage it appeared to be the registered owner of the BWM Gregory Weingart.
As I walked around Home Depot I located Gregory wearing the exact clothes described by the male. As I approached him I asked would he walk to the parking lot to have a discussion with me. Initially Gregroy reached toward is waist band but kind of turned away from me. I believed this was to fix his pants. Gregory continued to make these movements reaching into his pants. I ordered him to stop and grabbed his arms. Gregory tensed up and refused to allow me to pull his hands behind his back. I had to pushed him against a shelf to maintain control of him. I was able to detain Gregory in handcuffs without further incident.
I escorted Gregory to the patrol vehicles in the parking lot where I read Gregory his Miranda warnings. Gregory refused to speak to me without a lawyer present. Gregory asked what this was about. I told Gregory he was under arrest for public indecency and that I had a video of him naked at his vehicle. Gregory then made a several spontaneous utterances that he was just changing his pants. I did conduct a plain view search from the exterior of the BWM and saw no additional pants in the vehicle.
Gregory was placed under arrest. He was placed in handcuffs, double-locked behind his back, and checked for proper fit. Two pair of handcuffs were used due to complaint of a preexisting shoulder injury. Gregory was searched incident to arrest, and no contraband was found. The back seat of my patrol vehicle was checked at the beginning of the shift, at 0645 hours. Gregory was placed into my patrol vehicle and transported to Barrow County Jail, where he was turned over to jail staff without incident. The back seat of my patrol vehicle was searched before and after transport, and no contraband was found.
The warrant has been secured for (OCGA 16-6-8) public indecency. That Gregory was in a lewd appearance in a state of partial or complete nudity exposing his genitals in the Home Depot parking lot, a public place.
