On May 25, 2026 at approximately 2340 hours, I was on routine patrol in Winder. On Smith Cemetery Rd and University Pkwy, I responded Code 3 to an accident involving a red 2019 Toyota Camry with GA tag# [REDACTED].

The caller admitted to dispatch that he had been drinking and I was asked to come out to accident scene. On arrival I was directed to a black male standing behind the vehicle above. Upon initial contact with Hugues Pierre, a strong odor of an alcoholic beverage coming from his person. He informed me that he was rear ended while at the stop sign. I asked how much he had to drink and he stated he drank wine three to four hours ago. I asked if he would submit to standardized field sobriety and he agreed. Hugues stated he does not take any medications. Hugues stated he does not use any illegal drugs.

Each exercise was explained and appropriately demonstrated prior to having Hugues perform. Hugues also provided an affirmative response stating that he understood my instructions.

Horizontal Gaze Nystagmus (explained and observed);

Hugues stated that he does not wear contacts.

I told Hugues to stand with his feet together and hands at his sides. I asked Hugues to look forward and not move his head. I told Hugues to follow my stimulus with his eyes only. I asked Hugues if he understood, and he stated that he did.

Hugues’s eyes displayed equal tracking and equal pupil size. I then checked for lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and onset of nystagmus prior to forty-five degrees in both eyes.

Hugues displayed the following 6 clue(s) during the Horizontal Gaze Nystagmus exercise:

• Lack of smooth pursuit – Left eye then right eye
• Distinct and sustained nystagmus at maximum deviation – Left eye then right eye
• Onset of nystagmus prior to forty-five degrees – Left eye then right eye
• No vertical nystagmus observed

During this exercise he would sway to a severe degree and would laugh.

Walk and Turn (explained and observed);

Prior to attempting the Walk and Turn exercise, Hugues indicated no medical problems preventing performance. A flat, smooth surface was selected, and Hugues was instructed to use a marked line on the roadway. Hugues was told to place his left foot on the line and his right foot immediately in front, with the right heel touching the toe of the left foot. Hugues was instructed to stand with his hands at his sides and not to start until instructed. I confirmed that Hugues understood the instructions, and then I instructed Hugues to take nine steps in a heel-to-toe manner.

Hugues displayed the following 2 clue(s) during the Walk and Turn exercise:

• Improper turn: did not take small steps and did an about face
• Stepped off the line at steps 5 down

One Leg Stand (explained and observed);

Prior to attempting this exercise, Hugues was instructed to stand with his feet together and arms at his sides. Hugues was asked not to begin the exercise until instructed, and he confirmed that he understood.

Hugues was instructed to raise the foot of his choice approximately 6 inches while keeping it parallel to the ground. While holding that position, he was to keep his leg straight and count out loud while looking at their toe until instructed to stop.

Hugues displayed no clues during the One Leg Stand exercise. However, he failed to follow instructions by raising his foot higher than 6 inches. Hugues first attempt to complete this exercise, he raised his hand and foot and had to have the instructed a second time. During both the walk and turn and one leg stand Hugues did not count out loud.

I attempted to have Hugues blow into my portable breath device. However, his attitude shifted and refused. He tried to indicate that I did not tell him this was part of the test. I told him that this device was part of the testing. When I tried to understand why he was refusing, he would only repeat that he didn’t want to. He then attempted to have his wife get involved in the conversation and he was told that was not going to happen.

Based on my observations, the traffic violations and the general demeanor of Hugues led me to conclude that Hugues was operating a motor vehicle under the influence of alcohol. Hugues was informed he was being placed under arrest.

I immediately read the Georgia Implied Consent Notice for drivers 21 years old or older. Hugues refused to submit to a state administered chemical test of his blood.

Hugues Pierre was handcuffed behind the back. The handcuffs were double locked and checked for fit. A search of him person was conducted incident to arrest. No weapons or contraband or means of escape were located. Hugues was secured in the rear seat with a seat belt.

Hugues was escorted to the Northeast Georgia Hospital to be medically cleared and was shortly discharged by medical staff. Hugues was then escorted to the detention center and released to jail deputies without incident. A search of my rear seat was conducted before and after transport. No items were found.

My probable cause of arrest for the charges below is when Hugues Pierre was the victim of a rear-end collision and, upon investigation, was found to be under the influence after admitting to consuming alcohol.

Hugues was charged with:

O.C.G.A. § 40-6-391(a)(1) – DUI Less Safe

A person shall not drive or be in actual physical control of any moving vehicle while:

(1) Under the influence of alcohol to the extent that it is less safe for the person to drive.

O.C.G.A. § 40-6-390 – Reckless Driving

Any person who drives any vehicle in reckless disregard for the safety of persons or property commits the offense of reckless driving.

Hugues was issued a DDS 1205 form, which was explained to him, and he refused to sign.
