On June 13, 2026 at approximately 0132 hours, I was on routine patrol in Winder. On University Pkwy and McCarty Rd Deputy Hill performed a traffic stop on a black 2021 Nissan Rogue with GA tag [REDACTED] after I notified him that a vehicle passed me at 110 mph going East on University Pkwy.

Deputy Hill was able to find the vehicle above going at a high rate of speed and paced it at 122 mph in a 55mph construction zone. I joined Deputy Hill on his traffic stop and approached to the driver’s side window. Upon initial contact with the driver, Jamie Nichols, I could smell a moderate odor commonly associated with an alcoholic beverage coming from within the vehicle. Deputy Hill informed me that the driver just after he paced the vehicle locked its brakes attempting to turn right on McCarty Rd but alternated back onto University Pkwy at the last moment.

I had Jamie step out of the vehicle so she could be evaluated for field sobriety. Talking to Jamie, I could smell a strong odor commonly associated with an alcoholic beverage coming from her person. I asked Jamie where she was coming from and she broke down in tears and stated she was hurrying home from cheating on her husband. I asked how much she had to drink and Jamie stated she had 3 beers while she was there. Asking about prescription medications, Jamie stated she took suboxone two days ago because she had surgery on her foot and didn’t want to become addicted to narcotics. Jamie stated she does not use any illegal drugs.

I explained the concern of the reckless speed and the alcohol consumption and asked if she would submit for field sobriety testing and she agreed. Each exercise was explained and appropriately demonstrated prior to having Jamie perform. Jamie also provided an affirmative response stating that she understood my instructions.

Horizontal Gaze Nystagmus (explained and observed);
I told Jamie to stand with her feet together and hands at her sides. I asked Jamie to look forward and not move her head. I told Jamie to follow my stimulus with her eyes only. I asked Jamie if she understood, and she stated that she did. Jamie’s eyes displayed equal tracking and equal pupil size. I then checked for lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and onset of nystagmus prior to forty-five degrees in both eyes.

Jamie displayed the following 6 clue(s) during the Horizontal Gaze Nystagmus exercise:

• Lack of smooth pursuit – Left eye then right eye
• Distinct and sustained nystagmus at maximum deviation – Left eye then right eye
• Onset of nystagmus prior to forty-five degrees – Left eye then right eye
• Vertical nystagmus observed

Due to her foot injury, Walk and Turn was not performed.

One Leg Stand (explained and observed);
Prior to attempting this exercise, Jamie was instructed to stand with her feet together and arms at her sides. Jamie was asked not to begin the exercise until instructed, and she confirmed that she understood. Jamie was instructed to raise the foot of her choice approximately 6 inches while keeping it parallel to the ground. While holding that position, she was to keep her leg straight and count out loud while looking at their toe until instructed to stop.

Jamie displayed the following 3 clue(s) during the One Leg Stand exercise:

• Put foot down at seconds 1,20, 22
• Used arms for balance
• Swayed while balancing

During this exercise, Jamie never counted and stopped before being instructed. I made an effort to have Jamie utilized the portable breath test but she refused. Based on my observations, the traffic violations and the general demeanor of Jamie led me to conclude that Jamie was operating a motor vehicle under the influence of alcohol. Jamie was informed she was being placed under arrest. She was allowed to call her husband to come collect her vehicle.

I read the Georgia Implied Consent Notice for drivers 21 years old or older. Jamie refused to submit to both states administered chemical test of her breath and blood. Jamie Nichols was handcuffed behind the back. The handcuffs were double locked and checked for fit. A search of her person was conducted incident to arrest. No weapons or contraband or means of escape were located. Jamie was secured in the rear seat with a seat belt.

A probable cause search of the vehicle was conducted. Nothing was found. [REDACTED] arrived shortly after and took possession of the 2021 Nissan Rogue with GA tag [REDACTED]. Jamie was escorted to the detention center. A search of my rear seat was conducted before and after transport. No items were found.

My probable cause of arrest for the charges below is when Jamie Nichols was observed driving a 2021 Nissan Rogue with GA tag [REDACTED] at reckless disregard to her safety at 122 mph in 55 mph construction zone. Upon investigation of the traffic stop, Jamie admitted to consuming alcohol prior to driving and after submitting to standardized field sobriety testing was determined to be under the influence of alcohol.

Jamie was cited for the following:

O.C.G.A. § 40-6-391(a)(1) – DUI Less Safe
A person shall not drive or be in actual physical control of any moving vehicle while:
(1) Under the influence of alcohol to the extent that it is less safe for the person to drive.

O.C.G.A. § 40-6-390 – Reckless Driving
Any person who drives any vehicle in reckless disregard for the safety of persons or property commits the offense of reckless driving.

O.C.G.A. § 40-6-188(e) – Speeding in a Highway Work Zone
(1) In order for a person to be cited or convicted for exceeding a speed limit, reduced or otherwise, in any highway work zone as provided in paragraph (2) of this subsection, there must be present in the highway work zone at the time of the offense the signage required by this Code section and either:
(A) Work zone personnel; or
(B) Barriers, on-site work vehicles, or shoulder or pavement drop offs that constitute a hazard to the traveling public.
(2) Any person who drives a motor vehicle at a speed in excess of the speed limit posted in accordance with this Code section in a highway work zone shall be guilty of speeding in a highway work zone.

Jamie was issued a DDS 1205 form, which was explained to her, and she signed.
