On May 10, 2026, at approximatelv 1337 Hours I Officer Jacob Harris, was dispatched to a domestic dispute at [REDACTED BY AGENCY]. Dispatch advised the caller was behind Body Plex (350 Exchange Blvd. Bethlehem, GA, 30620. Dispatch advised the male half was inside the residence, possibly with a pistol. I responded CODE 1 (no lights and sirens) in my marked patrol unit #523 to the location because the parties were separated.

Upon arrival, I met with the Caller, [REDACTED BY AGENCY]. I asked [REDACTED BY AGENCY] what had happened. [REDACTED BY AGENCY] stated that she filed for divorce from her husband, later identified as Javon Herring, on Friday, May 8, 2026. [REDACTED BY AGENCY] stated that on Saturday, May 9, 2026, Mr. Herring stated that he was coming over to get his things. [REDACTED BY AGENCY] stated that she arrived home at approximately 1030 hours and found her garage door open. I asked [REDACTED BY AGENCY] how Mr. Herring got into her residence. [REDACTED BY AGENCY] stated that Mr. Herring had the garage door code. [REDACTED BY AGENCY] stated that she knew he was in the house. [REDACTED BY AGENCY] stated that she was looking for her phone charger and asked Mr. Herring where it was. [REDACTED BY AGENCY] stated that Mr. Herring stated that he gave it to one of his female friends. [REDACTED BY AGENCY] stated that they started arguing about him having another female around their daughter.

[REDACTED BY AGENCY] stated that she was sitting on the floor of her bedroom, going through new clothes she had bought for her juvenile daughter, [REDACTED BY AGENCY], (DOB [REDACTED BY AGENCY]) who was in the room with them. [REDACTED BY AGENCY] stated that at that time, Mr. Herring walked toward her and put his right hand around her neck until she saw stars and almost blacked out. [REDACTED BY AGENCY] stated that she heard her Juvenile [REDACTED BY AGENCY] crying and telling Mr Herring, “Don’t hurt Mama.” I asked [REDACTED BY AGENCY] if she had ever lost consciousness. [REDACTED BY AGENCY] stated she almost did, but Mr. Herring let go before she did.

[REDACTED BY AGENCY] stated that after that, Mr. Herring pulled her down the steps and threatened to kick her and throw things at her, but he didn’t. [REDACTED BY AGENCY] stated that she was in fear that Mr. Herring was going to hurt her again, so she grabbed her daughter and left the residence. I asked [REDACTED BY AGENCY] whether she would fill out a Winders Police Department Statement Form [REDACTED BY AGENCY] stated that she would, and the attachment will be included with this report.

At approximately 1418, Cpl. Cureington, Officer Flores, Officer Simmons with Auburn K9, and deputies from the Barrow County Sheriff’s office went to the residence and contacted Mr. Herring. Cpl. Cureington placed Mr. Herring’s wrist into two pairs of handcuffs, double-locked them, and checked them for proper fit. See Cpl. I asked [REDACTED BY AGENCY] if I could talk to Juvenile [REDACTED BY AGENCY]. [REDACTED BY AGENCY] gave me permission to talk to her. I approached Juvenile [REDACTED BY AGENCY] who was sitting in the back seat of [REDACTED BY AGENCY] car. I asked Juvenile [REDACTED BY AGENCY] whether she saw her dad (Mr. Herring) grab her mom [REDACTED BY AGENCY]. Juvenile [REDACTED BY AGENCY] stated that she did. I asked Juvenile [REDACTED BY AGENCY] to point out where her dad (Mr. Herring) grabbed her mom [REDACTED BY AGENCY]. Juvenile [REDACTED BY AGENCY] pointed to her neck and stated her neck.

I observed [REDACTED BY AGENCY] neck and noted bruising and swelling on the left side, with scratches. I took photos of [REDACTED BY AGENCY] injuries, which will be attached to this report.

Officer Simmons gave [REDACTED BY AGENCY] a business card with the case number and a Peace Place pamphlet. Officer Simmons apprised [REDACTED BY AGENCY] of the option that Winder PD and the surrounding organization can offer her.

At approximately 1430 hours, I met Cpl. Cureington and Mr. Herring over at Cpl. Cureington patrol unit. I walk Mr. Herring to the front of my marked unit and read him his Miranda Rights. I asked Mr. Herring if he understood his rights and if he would be willing to talk to me. Mr. Herring stated that he understood and he would talk to me.

I asked Mr. Herring what happened yesterday, May 9, 2026. Mr. Herring stated that nothing happened yesterday. I asked Mr. Herring how she got bruising and scratches on her neck. Mr. Herring stated that he didn’t know and guessed he was going to jail, but he didn’t know what happened, and said nothing did.

Upon my investigation, I established probable cause that Mr. Herring was the prominent aggressor. I found probable cause that Mr. Herring committed the offense of Battery Family Violence due to grabbing [REDACTED BY AGENCY] by the throat, causing bruising and scratches on her neck. Aggravated assault due to choking [REDACTED BY AGENCY] to the point of losing consciousness. Simple Assault due to [REDACTED BY AGENCY] was in fear of getting hurt again. And Cruelty in the third degree due to a juvenile witness, Mr. Herring, choking [REDACTED BY AGENCY]. Mr. Herring and [REDACTED BY AGENCY] are husband and wife, and they share a child, Juvenile [REDACTED BY AGENCY].

I informed Mr. Herring that he was being arrested for aggravated assault, battery, family violence, and cruelty to children in the third degree. I searched Mr. Herring incident to arrest for weapons, contraband, and any means of escape. Mr. Herring didn’t have any contraband on his person. I walked Mr. Herring to my marked patrol vehicle. I checked my back seat for contraband before placing Mr. Herring inside and properly securing him with a seatbelt. I placed Mr. Herring’s belongings on the front passenger seat of my marked patrol unit.

I left the scene en route to Barrow County Jail. I arrived at the Barrow County Detention Center, released Mr. Herring, and turned his belongings over to the staff without incident. I filled out a Victim Notification form and gave it to the Barrow County Detention Center. After transport, I checked the rear of my patrol vehicle for contraband, but no contraband was found.

The investigation of the incident was recorded on my assigned body-worn camera and in-car camera #523.

Four warrants were procured for Mr. Herring. The warrants that were procured are as follows.
