On 4/25/26 Deputy Antwune McCurry responded to [500 BLOCK] Hilldale Circle regarding a dispute. Upon arrival officers met with the homeowner outside the residence, who was identified to be [VICTIM #1]. While speaking with [VICTIM #1] she stated she had allowed her grandson Justin Baber to reside at the residence in a spare bedroom. In recent days she observed Justin to be acting strange immediately noticing him not to be staying inside the room. She observed Justin to be hanging around in the back yard of the residence around a gazebo she had in the rear of the residence.

[VICTIM #1] then contacted Justin outside to the rear of the residence observing him to have built a small fort inside her gazebo area, along with a dog tied beside the gazebo. She then confronted Justin attempting to question him about sleeping at the gazebo and cluttering up her backyard gazebo space. It was then things escalated between the two and Justin began screaming and yelling toward his grandmother in which several neighbors heard the dispute due to it disturbing the peace and called Barrow County E-911.

Officers met Justin in the rear of the residence. While speaking with Justin, I immediately observed him to be tweaking, extremely dry mouth, furtive movements, and talking loudly. We spoke with him briefly concerning the dispute and he began rambling, pointing his fingers, and using profane language continuously blaming [VICTIM #1].

He stated the reason for him residing outside at the gazebo is because he didn’t want to share a room with his juvenile son and wanted his own space. As officers continued speaking with Justin he began arguing with [VICTIM #1] again. He immediately begins using obscene, profane language toward her in an aggressive manner calling her vulgar names.

Officer then pat frisk Justin for weapons and officer safety. During the pat down I observed him having several rounds of ammo inside his pocket. He advised officers he had been in the back yard sighting in a rifle scope. I asked him about owning a firearm and if he was a convicted felon. He then recanted his statement saying he didn’t fire the rifle, and the ammo didn’t belong to him.

At this time [VICTIM #1] then spoke up, and verbal admitted that Justin had in fact been in the backyard prior to our arrival shooting a firearm. He begins to speak over [VICTIM #1] calling her a “Liar”.

After explaining to [VICTIM #1] the eviction process and several options to process forward she requested that we complete a walk around of the property specifically the gazebo to confirm no firearms were present for her safety and other family members due to Justin being a convicted felon and he state of mind acting as if he was consuming some sort of narcotic.

As [VICTIM #1] escorted officers to the gazebo Justin begins walking ahead at a fast pace. He then attempted to flee from officers on foot and was immediately detained.

While officers were scanning the immediate area next to the gazebo officers observed in plain sight concealed underneath the gazebo a Keystone arms (cricket) 22 Caliber rifle in which Justin had the ammo inside Justin pocket positively matched. He begins acting dumbfounded about the firearm later making the statement that he loves “Guns”.

I then reached out to Barrow County Dispatch and confirmed Justin was a convicted felon. He was then placed under arrest and cuffed to the rear. Cuffs were double locked and fitted for tightness. Justin then begins screaming, hollering, becoming irate calling [VICTIM #1] vulgar names, and blaming her for his arrest.

Officers then attempted to escort Justin to my patrol vehicle. While escorting him he begins to resist by attempting to elbow officers, kick, jerk away aggressively, and kick. He was immediately softly escorted to the ground and brought under control. Once under control officers escorted him to the patrol vehicle and safely buckled him inside.

I transported Justin to the Barrow County Detention Center and released him to staff.

Back seat check was conducted before and after arrest effected.

I later secured criminal warrants for the offenses :1) Disorderly Conduct 16-11-39, 2) Possession of firearm by convicted felon16-11-131, 3) Obstruction of an officer 16-10-24.

The Firearm was transported to Barrow County Sheriff’s office logged, tagged, and secured into evidence along with being processed through the department lerms system.
