On Saturday, 07/11/26, at 0347 hours, I, Officer Scoggins, (516), was dispatched to the Waffle House at 1917 Atlanta Highway, Statham GA 30666, in reference to a suspicious person and vehicle. Dispatch advised the complainant said there was a male was passed out with the vehicle in drive and was slumped over the steering wheel. The complainant advised the vehicle, and male driver had been in the parking lot with the vehicle running for an hour.
I arrived and parked my vehicle in front of the running Cadillac Escalade, GA Tag [REDACTED BY AGENCY], to prevent startling the driver and having him possibly driving away in the vehicle. I approached the driver, Kendrick Sturdivant (DOB: [REDACTED BY AGENCY]), who was passed out in the drivers’ seat with the vehicle running. The drivers’ door was slightly ajar but not closed. I opened the car door and attempted to wake up Mr. Sturdivant. I tried to wake him verbally and banged on the side of the vehicle. I also attempted to wake him by jostling his arm and shining a flashlight in the drivers’ area. Mr. Sturdivant slowly woke up and spoke in mumbled and slurred speech. Mr. Sturdivant stated he hadn’t been driving. I explained he was passed out in his vehicle, and I needed his driver’s license. Mr. Sturdivant looked for his driver’s license for several minutes in passenger floorboard, center console and finally found his driver’s license in a wallet inside bag behind his seat.
I requested 2nd unit for backup who was field sobriety trained. I checked his drivers’ license status with dispatch. I explained I needed to make sure he was alright as it was not normal to be passed out in your vehicle. Mr. Sturdivant asked to go to bathroom several times. I explained he would need to hold it until we got done. Smelling an odor of alcohol, I asked the driver if he had anything to drink tonight? He stated no and told me to stop. Mr. Sturdivant called someone to come pick him up but spoke with slurred and incomplete speech. Mr. Sturdivant asked to close door, pi*s and go inside several times, to which I answered no.
(DON’T SMELL OVERWELMING ALCOHOL)
Barrow County Sherrif’s Deputy Sanson (S149) arrived and attempted to establish time frame of when Mr. Sturdivant drove up via the FLOCK cameras.
I went inside Waffle House and spoke with the complaint [REDACTED BY AGENCY] who stated the vehicle had been there one hour and fifteen minutes. Mr. [WITNESS #1] stated he didn’t know he was passed out until a customer came in and told them. Mr. [WITNESS #1] stated he definitely drove up in the vehicle but didn’t come in and had been sitting in the vehicle with his lights on.
Deputy Sanson (S149) asked where Mr. Sturdivant was coming from. Mr. Sturdivant stated he was coming from Texaco and was doing what I do making sure everyone is the whole community is straight. Deputy Sanson (S149) asked if Mr. Sturdivant would do field sobriety testing and asked if he could look at his eyes. As Deputy Sanson was asking the question, Mr. Sturdivant lost his balance and fell against the rear of his vehicle. Mr. Sturdivant then pulled out his pen*s and urinated in the parking lot. Deputy Sanson again asked how much Mr. Sturdivant had to drink? Mr. Sturdivant held up his hand and wouldn’t answer.
Mr. Sturdivant put his hand on vehicle to steady himself then put his hands behind his back. Mr. Sturdivant stated several times to “do what you gotta do”. Deputy Sanson asked several times to look at Mr. Sturdivant eyes and asked to do a portable breath test. Mr. Sturdivant again put his hands behind back almost falling backwards. Mr. Sturdivant again stated, “do what you gotta do”. Mr. Sturdivant asked to turn his vehicle off. The vehicle was already off.
I asked again where he was coming from and explained he said he was coming from Texaco but Texaco had been closed for several hours. Mr. Sturdivant admitted he was coming from the pool hall. I asked Mr. Sturdivant how much he had to drink, he stated he “didn’t know and don’t do me like that”. Mr. Sturdivant stated he owned several buildings in Statham. Mr. Sturdivant stated he was trying to protect his community.
During the entire interaction with Mr. Sturdivant, I observed the odor of an alcoholic beverage, bloodshot eyes and slurred at times incoherent speech. Mr. Sturdivant was unable to tell a linear story and was unsteady several times on his feet.
I asked Mr. Sturdivant, who was sitting on the curb, to stand up. Mr. Sturdivant didn’t move. Deputy Sanson and I asked Mr. Sturdivant to stand up at least 5 more times. Mr. Sturdivant eventually rolled over on the ground by himself and put his hands behind his back. Mr. Sturdivant was placed under arrets for driving under the influence. Mr. Sturdivant was picked up off the ground, and his handcuffs were double locked and checked for proper fit. Mr. Sturdivant was secured in the rear of my patrol vehicle. Mr. Sturdivant was read the current Georgia Implied consent card and refused testing. Mr. Sturdivant’s vehicle was searched incident to arrest. I retrieved Mr. Sturdivant’s cell phone from the vehicle.
I returned to my vehicle, and completed a vehicle impound sheet. I issued Mr. Sturdivant citations for DUI less safe citation (S0007617) and Public Indecency (S0007618). Mr. Sturdivant was transported to the Barrow County Jail and turned over to intake Deputies without incident. Deputy Sanson waited for Hammonds Wrecker who towed the vehicle. I secured digital video footage of Mr. Sturdivant driving into the parking lot.
