On 06/02/2026 at approximately 1410 hours, I was on patrol in the area of Jefferson Hwy and Hwy 211 NE. While in the parking lot of the Chevron at 879 Jefferson Hwy, I observed a male, later identified as Kenneth Oliver, exiting the gas station holding a pack of White Claw. I observed Kenneth pumping gas into a Jeep Cherokee bearing a GA tag [REDACTED]. Kenneth was swaying back and forth while standing next to the pump, and his eyes were bloodshot and glassy.
I observed Kenneth getting into the driver’s seat and driving the Jeep out of the parking lot. I followed Kenneth Westbound on Rockwell Church Rd NE and observed the Jeep weaving within its lane of travel, touching the fog line several times. I also observed the vehicle activating its brake lights while fluctuating its speed.
Based on my knowledge, training, experience, and the totality of the circumstances, I identified this driving behavior to be consistent with impaired driving. Based on these observations mentioned above, I initiated a traffic stop by activating the blue lights on my patrol vehicle near the intersection of Moon Bridge Rd and Moonlite Trace. Once the vehicle came to a stop, I got out of my patrol vehicle and approached the passenger side where I met Kenneth.
I explained the reason for the stop and asked for his driver’s license, which he provided. While speaking to Kenneth, I smelled a strong odor of an alcoholic beverage coming from his breath and observed that his eyes were bloodshot and glassy.
I asked Kenneth to step out of the vehicle, and he complied. I asked Kenneth if he had any alcohol, and he stated that he had one White Claw approximately one hour ago. I asked Kenneth if he had anything else, and he stated that he was drinking the night before but stopped at approximately 0100 hours.
I then asked Kenneth if he was willing to participate in field sobriety exercises to determine if he was okay to drive, and he agreed. I asked Kenneth if he had any medical conditions that would prevent him from standing, walking, or turning, and he stated that his left ankle was injured. I asked Kenneth if he was wearing eye contacts, and he stated no.
I told Kenneth to stand with his feet together and his hands down at his side. I told Kenneth to stay in that position while I explained what he needed to do. I asked Kenneth to look forward and not move his head. I told Kenneth to follow the tip of my pen with his eyes only. I asked Kenneth if he understood, and he stated that he did.
I checked for equal pupil size and detected it. I checked for resting nystagmus but did not detect it. I checked for equal tracking and detected it. I checked for lack of smooth pursuit and detected it in both eyes. I checked for distinct and sustained nystagmus at maximum deviation and detected it in both eyes. I checked for the angle of onset of nystagmus and detected it in both eyes. I checked for vertical nystagmus and did not detect it. I observed 6 out of 6 clues.
I told Kenneth to stay in that position and told him I was going to circle his face with my pen. I told him to follow the pen with both eyes. I told Kenneth that I would bring it towards his nose, and he was to follow it with both eyes. I told Kenneth that if he needed to cross his eyes, that was okay. I asked Kenneth if he understood, and he stated that he did.
I checked for lack of convergence and did not detect it. I told Kenneth to stand with his feet together and his hands down at his side. I told Kenneth to stay in that position while I explained what he needed to do. I told Kenneth that when instructed, he was to lean his head back and close his eyes. I told Kenneth that when I told him to begin, he was to estimate the passage of 30 seconds. I told Kenneth that when he thought 30 seconds had elapsed, he had to open his eyes and say stop. I asked Kenneth if he understood, and he stated that he did. I told Kenneth to lean his head back and close his eyes. I told him to begin.
Kenneth estimated 30 seconds in 26 actual seconds. I observed that Kenneth had eyelid tremors, body tremors, and a sway. Due to Kenneth’s complaint of having an injured ankle, I used my discretion to not have Kenneth perform the walk and turn evaluation portion.
I told Kenneth to stand with his feet together and his hands at his sides, and he complied. I told Kenneth I was going to demonstrate the one-leg stand evaluation. I told Kenneth not to begin until told to do so. I asked if he understood, and he stated that he did. I demonstrated how Kenneth was to lift a foot of his choice approximately six inches off the ground and pointed it out parallel with the ground. I explained that he was to keep both legs straight and keep his hands at his sides. I told Kenneth to look at the raised foot and count out loud in the following manner: 1001, 1002, 1003, etc., until told to stop. I asked Kenneth if he understood, and he stated that he did. I told Kenneth to begin.
Kenneth did not count as explained. I observed Kenneth swaying, putting his foot down, and raising his arms for balance. I observed 3 out of 4 clues. I retrieved my portable breath tester, and Kenneth provided a breath sample that was positive for the presence of alcohol (BAC .192%)
I placed Kenneth under arrest in a set of handcuffs behind his back, which I double locked and checked for proper fit. I then read Kenneth the Implied Consent notice for individuals age 21 or over and asked if he would take the state-administered breath test.
Kenneth agreed to provide a breath sample at the detention center by stating yes. I then secured him in the back seat of my patrol vehicle and fastened the seatbelt. The vehicle was turned over to Kenneth’s son at the scene per Kenneth’s request without further incident.
I transported Kenneth to the Barrow County detention center, where he provided two breath samples for the Intoxilyzer 9000, which I operated. Both breath samples were positive for the presence of alcohol. The lower sample had a BAC of 0.222%.
I completed a Form 1205 and explained it to Kenneth. Kenneth signed the form, and I placed his copy along with a copy of the breath test results with his property. Kenneth was cited for the following violations.

The original court copies were dropped in the citation box located in the pre-booking area of the detention center without further incident. The 1205 Form, along with Kenneth’s driver’s license, was turned in at the Barrow County Sheriff’s Office for processing.
