[NARRATIVE #1 on July 05, 2026]
While traveling southbound on Christmas Avenue near Shephard Street, V2 (a Kenworth Construction Semi-truck with license plate [REDACTED]) was struck by V1 (a red Chevrolet GMT400 with license plate [REDACTED]). V2 (the Kenworth Construction Semi-truck with license plate [REDACTED]) was also towing a tanker trailer with Maine license plate [REDACTED]. According to dash camera footage from V2, V1 can be seen exiting the Super H gas station and merging into V2. See attached docs for dash camera footage provided by V2.
I was advised by both the driver of V2 and a passerby that V1 proceeded to turn around in the roadway and in doing so; V1 backed up (to turn around) and struck V2 again. The location of damage was on V2’s trailer (the tanker trailer with Maine license plate [REDACTED]). All parties reported no injuries.
The driver of V1 appeared to be under the influence. Dep. McIntosh ran the driver through SFSTs. V1 was impounded by Myles. The following citations were issuded to the driver of V1:

[NARRATIVE #2 on July 05, 2026]
On 07/05/2026 while on routine patrol in my marked patrol vehicle, I responded to assist Dep. Whalen with an accident with no injuries on Christmas Ave. at E. Shepherd St. in Bethlehem, GA. While Dep. Whalen was en route to the call, dispatch advised the male driver of one of the vehicles was possibly intoxicated. Dep. Whalen requested that I be en route to assist with a sobriety investigation. I arrived on scene and Dep. Whalen was speaking with the possibly intoxicated male, identified as Mr. Kevin Davis. Upon initial approach and contact, from several feet away I could smell the odor of alcoholic beverage emitting from Kevin. Kevin was swaying around while standing and slurring his speech, having watery and bloodshot eyes.
I began speaking with Kevin and asked where his vehicle was, which he pointed to it in the parking lot of Super H, having damage to the front bumper and passenger fender. Kevin immediately stated “I ain’t did nothin”, which he repeated multiple times. I asked his age and he stated 52 years old. Kevin confirmed he was pulling out of the Super H, onto Christmas Ave and heading towards Monroe, GA. I asked Kevin if he took medications and he stated yes, since he was “fixin to have surgery”, advising they were ” which is a combination of and This is a powerful medicine, not to be mixed with alcohol. I asked Kevin if he uses illegal drugs such as heroin, methamphetamine or marijuana and he stated no. Kevin in his slurred speech stated he pulled over to handle what had happened, referencing the accident, where he apparently struck a semi-truck. The semi-truck was still in the roadway on Christmas Ave.
I asked Kevin when was the last time he had an alcoholic beverage, he replied, “I had uh, I did a today though, for real though”. I asked how long ago that was and he stated “2 to 3 hours”. Kevin continued to ramble on with slurred speech as I spoke to Dep. Whalen, continuing with stating he had not done anything. I asked again when was the last time he had an alcoholic beverage, stating “3 or 4 hours ago”. This meant in the last roughly 3 hours he had drank an alcoholic beverage and taken a Kevin stated he drank a beer, when asked what kind he stated it was a Bud Light. Kevin kept trying to go back to the topic of him pulling over to do the right thing and he had not done anything wrong, which he appeared heavily intoxicated, still swaying around while standing. I walked Kevin back over to the Super H parking lot where his vehicle was and advised I would like to conduct testing to ensure he was safe to drive and he agreed.
I asked Kevin if he wore contacts or glasses, he stated no. I confirmed the only medicines he was taking was the Kevin kept speaking and most of it was so slurred and garbled that I could not understand what he was saying. I walked Kevin over to the level sidewalk next to the store in the lights to conduct HGN.

Comments: Kevin swayed around in his stance, had heavy eyes almost as if he was falling asleep, the eyes were watery and bloodshot. Kevin had to be reminded to follow the stimuli several times as he would lose focus and interest and either look at me or just not follow the stimuli. The nystagmus witnessed was large jumps and heavy jerking, so pronounced it was seen immediately when checking onset. This immediate onset is an indication of high levels of impairment. The presence of vertical nystagmus is an indication of high levels of impairment for a particular individuals tolerance. Kevin had to be re-focused multiple times during this and his swaying was so bad that I decided this would be the only test conducted due to safety precautions. Kevin was also starting to get agitated while testing.
I then retrieved my hand held alco-sensor from the approved GBI list and explained to Kevin how to provide a sample. Kevin went to provide a sample twice with only a small puff of air, then got agitated with me as if I was either messing with him or doing something shady. I was able to get him to attempt it once more, getting a small puff of air and clicking a quick sample, which showed a positive result for the presence of alcohol. The sample was extremely small, but showed a BrAC of 0.178, which made me curious what a full sample would have been.
I concluded that Kevin was extremely intoxicated and should never have been behind the wheel of a motor vehicle, due to him causing an accident, smelling of alcoholic beverage from several feet away, admitting to drinking and taking a strong pain medicine, with all the manifestations it was causing as well. There was no doubt he was less safe to drive by way of alcohol.
I placed Kevin in handcuffs, behind his back, in two sets due to his stature, checking them for fit and double locking them. I advised Kevin he was under arrest for DUI and walked him to my vehicle. Dep. Wilkins assisted in searching Kevin incident to arrest, as I held him secured since he was becoming very agitated and belligerent. I seated Kevin in my patrol vehicle. I then read the Georgia Implied Consent Notice Suspects Age 21 or Over, word for word, from an official green in color card and asked for “blood”. Kevin refused Implied Consent but had verbally berated me the entire time I was reading it, arguing and cursing with himself basically, but towards me as I was reading from the card. I buckled his seat belt in preparation for transport.
Dep. Wilkins and I conducted a search incident to arrest of Kevin’s vehicle for evidence of the crime of DUI, no recent open containers were located inside the vehicle. While searching his vehicle I noticed the rear driver side tire was completely bald and the other tires had little to no tread on them.
I spoke with Dep. Whalen prior to transporting Kevin and confirmed he was at fault in this accident. Kevin had pulled onto Christmas Ave. into the semi-truck, striking it, then backing up in the roadway and striking it again. This was captured on the truck and business cameras from Super H. Kevin had failed to yield entering the roadway and caused this accident, being extremely intoxicated.
I transported Kevin to the Barrow County Detention Center where he was turned over to jail staff. Kevin was issued four citations for; DUI Alcohol Less Safe, Failure to Yield When Entering Roadway, Improper Backing, and Defective Tires. I completed a DDS 1205 form for the Implied Consent refusal, attempted to explain this to Kevin but he again wanted to argue so I explained it anyway and signed it as jailed due to his behavior at the jail. Kevin was provided a copy and the DDS copy was submitted at BCSO UPD to be sent to DDS.
Dep. Whalen completed the accident portion and report for this incident, using the same case number as this report.
