[NARRATIVE #1 on August 03, 2026]

On August 3, 2026, at approximately 0903 hours, I responded to an accident with no injuries at 737 Harry McCary Rd. While investigating the accident, I could smell the odor of alcohol coming from Driver 1, Luis Colon. Luis backed into a parked car in a parking spot hard enough that he moved the car a couple of feet. When I arrived, Luis was still in the driver’s seat, attempting to back a trailer up. Due to the smell of alcohol coming from him, I asked him if he had anything to drink. He admitted to drinking a half bottle of wine the night prior. I then asked for Sgt. Wright to respond to the scene to determine whether or not Luis was safe to drive.

Sgt. Wright arrived on scene, and after preforming fields on Luis, he determined that Luis was under the influence of alcohol and should not be operating a motor vehicle. Sgt. Wright then read the implied consent for blood to Luis, which he agreed to. Luis was then placed in a pair of double-locked handcuffs and checked for proper fit. He was then placed in the backseat of my patrol car, where he was transported to Northeast Georgia Barrow to get his blood drawn.

Luis had his blood drawn by [REDACTED] and the GBI DUI blood draw kit was sealed by her. I placed the sealed GBI DUI Blood draw kit into evidence. Luis was transported to the Barrow County Detention Center and turned over to jail staff without issue. The backseat of my patrol car was checked before and after transport. Luis was issued the following Citation.

Citation #MCE031705 OCGA 40-6-391 DUI Less Safe.

I issued Luis a 180-day driving permit on the back of his citation and explained it to him.

[NARRATIVE #2 on August 03, 2026]

On 8/3/2026 at 0930 hours, I was dispatched to 737 Harry McCarty Rd to assist with a traffic investigation. I responded code 1. On arrival, I was met by Deputy L. Bradley who stated that he had responded to a crash at this address. He stated that Luis Colon was driving a silver Ram pickup truck and was pulling a trailer. Bradley stated that Luis hit a parked car with the trailer. Bradley stated that he detected the strong odor of an alcoholic beverage coming from Luis. He stated that Luis told him that he had drunk a half a bottle of wine at around 2100 hours the previous evening. See Deputy L. Bradley’s Case and Crash reports.

Bradley stated that he suspected impairment and asked me to investigate. I went to Luis and asked him what had happened. He stated that he had pulled the pickup truck and trailer to the dumpster to dispose of counter tops and struck another vehicle. He stated that he hit the vehicle with the trailer. I told Luis I wanted to perform some evaluations to assess his ability to drive and asked if that was okay. Luis agreed to participate saying yeah, yeah, yeah. I asked Luis if he had drunk wine the night before and he stated that he had. I asked what kind and he said white wine. I asked how much and he stated half a bottle at 2100 hours. I asked Luis if he took any drugs or had any medical conditions and he stated that he did not. I asked if he used any illegal drugs and he stated that he did not.

I detected the strong odor of an alcoholic beverage. I told Luis to stand with his feet together and his hands at his sides. I asked Luis to look forward and not move his head. I told Luis to follow my light with his eyes only. I asked Luis if he understood and he stated that he did. Luis had to be reminded not to move his head. I checked for equal pupil size and detected it. I checked for resting nystagmus, but did not detect it. I checked for equal tracking and detected it. I checked for lack of smooth pursuit and detected it in both eyes. I checked for distinct and sustained nystagmus at maximum deviation and detected it in both eyes. I checked for angle of onset of nystagmus and detected it at 40 degrees in both eyes. I checked for vertical nystagmus and did not detect it. He had a sway and his eyes were bloodshot. I detected six clues.

I told him to stay in that position and told him that I was going to circle his face with my light, I told Luis to follow the light with both eyes. I told Luis that I would bring it towards his nose and he was to follow it with both eyes. I told Luis that if he needed to cross his eyes that was okay. I asked Luis if he understood and he stated that he did. I checked for lack of convergence and observed it. Neither eye would go to center.

I told Luis to stay in that position with his feet together and his hands at his sides. I told Luis to stay in that position while I explained what he needed to do. I told Luis that when instructed he was to lean his head back and close his eyes. I told Luis that when I told him to begin, he was to tell me when he thought 30 seconds had elapsed. I told Luis that when he thought 30 seconds had elapsed, he was to open his eyes and say stop. I asked Luis if he understood and he stated that he did. I told Luis to lean his head back and close his eyes. I told him to begin.

Luis estimated 30 seconds in 36 actual seconds. He stated that he counted normally. He had a sway. I showed Luis a straight line and to place his left foot on it. I told Luis to place his right foot in front of it, heel-to-toe. I told Luis keep his hands at his sides and demonstrated. I told Luis to stand in that position while I demonstrated the nine step walk and turn evaluation and not to begin until told to do so. I asked if he understood and he stated that he did. Luis lost his balance and stepped out of position. He was returned to position.

I demonstrated how Luis was to take nine heel-to-toe steps remaining on the line. I explained that on the ninth step Luis was to keep his front on the line and turn around with a series of small steps with the rear foot. I explained that Luis was then to return nine heel-to-toe steps. I explained that he was to look at his feet, count his steps aloud and keep his hands at his sides. I explained that once Luis began, he was not to stop until complete. I asked Luis if he understood and he stated that he did. I told Luis to begin. On the first nine steps, Luis missed heel-to-toe by more than one half inch on steps 2, 3 and 9. He stepped offline on step six. He raised his arms more than six inches. Luis stopped and asked what to do next. I reminded him that he said that he understood the instructions. On the second nine steps, Luis missed heel-to-toe by more than one half inch on steps 2, 3, 4, 5, 7, 8, and 9. He raised his arms by more than six inches.

I observed one clue in the instructional stage and four clues in the walking stage.

I told Luis to stand with his feet together and his hands at his sides and he complied. I told Luis I was going to demonstrate the one leg stand evaluation. I told Luis not to begin until told to do so. I asked if understood and he stated that he did.

I demonstrated how Luis was to lift a foot of his choice approximately six inches off the ground and pointed out. I explained that he was to keep both legs straight and keep his hands at his sides. I told Luis he was to look at the raised foot and count aloud in the following manner, 1001, 1002, 1003, etc. until told to stop. I asked Luis if he understood and he stated that he did. I told Luis to begin.

Luis raised his arms by more than six inches, swayed and put his foot down six times. He missed counted at 1009 and started again at 1006.

I observed three clues in the counting and balance stage.

I retrieved my portable breath tester and Luis provided a breath sample that was positive for the presence of alcohol (BAC.076). I placed Luis under arrest. I read Luis the Implied Consent notice for individuals aged 21 years and above and asked if he would take the state administered blood test. Luis agreed to provide a blood sample at the hospital saying yes.

Deputy L. Bradley took custody of Luis.
