On 05/17/1016 at approximately 1047 Hours, I, Ofc. Dutcher, J #141 was dispatched to 59 W May St, Winder, GA. 20680 (Speedy Burrito) in reference to a Dispute. I traveled code 1 in my marked patrol vehicle #382

Upon my arrival, I met with [VICTIM #1], who stated that she went to Speedy Burrito to pick up her order when she noticed the sister of a female she had had problems with in the past. [VICTIM #1] then stated that while she was inside the restaurant, the sister (JUVENILE) [REDACTED BY AGENCY] was giving her dirty looks the entire time. [VICTIM #1] then stated that she had finally gotten her food and proceeded to leave Speedy Burrito and proceed to her vehicle. She then stated that Lyndsey Hayley (The girl she had had previous issues with) showed up in another truck and was in the passenger seat. [VICTIM #1] then stated that Lyndsey’s vehicle was parked behind her vehicle, and Lyndsey proceeded to yell and argue out of the window before eventually exiting the vehicle.

[VICTIM #1] then stated that Lyndsey then approached her and began yelling at her, “You ain’t nothing without your big sister.” Before shoving [VICTIM #1]. [VICTIM #1] then claimed that Lyndsey shoved her and began hitting her multiple times. [VICTIM #1] stated that Lyndsey knocked her to the ground and began striking her multiple times, causing her head to hurt and knocking her glasses off her face. Upon further investigation, I observed [VICTIM #1] did have red marks on the bridge of her nose, a red mark/ bruise on her right cheek below her eye, and a minor laceration on her neck. [VICTIM #1] also stated that her glasses were knocked off her face and sustained scratches on the lenses.

[VICTIM #1] then stated that Lyndsey and Lyndsey’s sister [REDACTED] (The driver) proceeded to get back into their vehicle and leave the scene. [VICTIM #1] did advise me that the 2rd sister (JUVENILE) [REDACTED BY AGENCY], was still inside Speedy Burrito as she worked there. I then entered Speedy Burrito and located (JUVENILE) [REDACTED BY AGENCY] and asked her to come speak with me outside, which she did. I asked her to explain what happened, and she stated that she was made aware of the fight, but the vehicle blocked her view, so she wasn’t able to see the exact situation.

I then attempted to get more information from [REDACTED BY AGENCY], such as her sister’s information and their home address, but she was very reluctant to comply. I then informed her that, since she is a minor, I would like to speak with her mother ([WITNESS #1]), and asked her to call her mother and have her en route. [REDACTED BY AGENCY] then called her mom and informed me that her mother stated that she was not involved and was refusing to arrive. I then told her to explain to her mom that if she was aware of the fight and refused to comply, she could face legal action as well. After several attempts, [WITNESS #1] finally agreed to come to the scene.

While waiting on [WITNESS #1] to arrive, I made contact with [WITNESS #2], who was a witness to the incident. [WITNESS #2] stated that Lyndsey works at Speedy Burrito and clocked out and left while [VICTIM #1] was waiting for her food. He then stated that after [VICTIM #1] had gotten her food, Lyndsey pulled up in another truck and started the confrontation with [VICTIM #1]. [WITNESS #2] then claimed that Lyndsey got out of the vehicle and began shoving [VICTIM #1] to the ground and striking her multiple times. I then went inside and found the manager and asked to see the video footage, to which he obliged. In the video, you could see a pickup truck pull up behind [VICTIM #1]’s vehicle in the spot that [VICTIM #1] claimed; however, the vehicle blocked the camera, and you were not able to see the physical confrontation.

Moments later, [WITNESS #1] arrived on scene and was asked to contact Lyndsey and have her en route back to Speedy Burrito. After several attempts, Lyndsey agreed to come back to the scene. Shortly after Lyndsey arrived on the scene. I then began speaking with Lyndsey and asked her to explain what happened. Lyndsey stated that she had clocked off work and seen that [VICTIM #1] was there, and they both exchanged dirty looks to each other. Lyndsey then admitted that she did confront [VICTIM #1] and exited her vehicle before pushing [VICTIM #1] to the ground and striking her multiple times.

Lyndsey was then placed in handcuffs, double locked, and checked for proper fit. Lyndsey was then searched for any weapons, contraband, or means of escape, with negative findings. The back seat of my patrol vehicle was also cleared of any weapons, contraband, or means of escape with negative findings. Lyndsey was then placed in the rear passenger side seat of my marked patrol vehicle, with the seatbelt being placed over her and buckled in for safety.

I then provided Central Dispatch with my starting mileage before proceeding to the Barrow County Detention Center. Upon arrival at BCDC, I relinquished custody of Lyndsey and her property to Barrow County Sheriff’s Office Correctional Officers. I then cleared the backseat of patrol vehicle #281 of any weapons, contraband, or means of escape with negative findings.

[WITNESS #1] and [VICTIM #1]’s mother, [REDACTED], was also provided with a business card and a case number, and was explained how to obtain a copy of the report if they so wished. Lyndsey was arrested for Battery, Disorderly Conduct, and Criminal Trespass.
