On July 31st, at approximately 2024 hours, I responded code one to 440 Atlanta Highway NW in reference to a criminal trespass.
Upon arrival, I met with the loss prevention employee of Walmart, [WITNESS #1], in the loss prevention office. [WITNESS #1] told me she identified a male shopping in the store who had an active notice of prohibited entry for life from the store. [WITNESS #1] identified the male as Marc Elliot. [WITNESS #1] provided me with a copy of the lifetime prohibited entry for Marc. [WITNESS #1] then advised she believed the female he was with, also had a notice of prohibited entry but could not identify her.
Marc and the female were in the process of checking out at a self-checkout. [WITNESS #1] and I observed the two on the security cameras. The couple hid several items inside other items and under scanned others. The couple then walked towards the exit of the store where [WITNESS #1] made contact with them and told them to follow her to the loss prevention office. I asked the male and female for identification. The male positively identified himself as Marc Elliot. The female identified herself as Tracie Hollis.
[WITNESS #1] confirmed that Tracie was also banned from the store and was given a notice of prohibited entry for a period of five years back in 2019. [WITNESS #1] explained to Marc and Tracie why they were being detained. Marc and Tracie both stated they thought their ban was lifted after a year.
Walmart employees went through the items in the couple’s shopping cart and removed everything that was not paid for. In total, the items stolen was $155.34. [WITNESS #1] advised that Walmart did want to prosecute for the shoplifting. A copy of the receipt of stolen items will be attached to this report.
Marc and Tracie were both issued new notice of prohibited entries. Marc and Tracie were both placed into handcuffs, which were checked for correct fit, and double locked. Marc and Tracie were transported to the Barrow County Detention center and turned over to detention staff without incident.
Probable cause developed this investigation supported the following charges against Marc and Tracie.
OCGA 16-7-21(b): Criminal trespass unlawful entry. Marc Elliot and Tracie Hollis did commit the offense of Criminal trespass. Marc and Tracie were a part of a theft investigation at Walmart. Both Marc and Tracie were previously issued a notice of prohibited entry and were both banned from the location.
OCGA 16-8-14: Theft by shoplifting. Marc Elliot and Tracie Hollis did commit the offense of theft by shoplifting. Marc and Tracie did attempt to leave Walmart with $155.34 worth of product they did not pay for.
The new notice of prohibited entries was turned into the Barrow County Sheriff’s Office.
