On 07/11/2026 at 0132 hours, I (Sgt. Wolfe) was riding with Cpl. Perrin and we were on the way back to the Winder Police Department from Akins when we observed a black vehicle stopped on Horton Street at W. May Street, Winder, GA. The vehicle was stopped at the intersection, and it had a green light. We observed the vehicle not move, despite having the green light. The light then cycled to a red light.
We activated our emergency equipment and got behind the black Toyota Corolla (GA TAG [REDACTED]). We then approached the vehicle, where I observed a black male driver, later identified as Marquavious Billings, passed out in the driver’s seat with the vehicle still in drive. We began knocking on the window, and after several moments, Mr. Billings awoke and grabbed a Gatorade from the center console, as we were giving him commands to open the door. Mr. Billings opened the door to the vehicle, and we immediately observed the strong odor of marijuana. We advised Mr. Billings to place the vehicle in park, which he did, after he began rolling down the back driver’s side window.
We advised Mr. Billings to step out of the vehicle. Mr. Billings stepped out and then stumbled, falling back into the driver’s door. I had Mr. Billings come toward me, and I began speaking with him. I observed a strong odor of marijuana emitting from his person, along with a strong odor of an alcoholic beverage. I asked him how much he had to drink tonight, and he stated not a lot. I asked him how much marijuana he smoked, and he stated not a lot. While speaking to Mr. Billings, I observed that he had watery, glossy eyes and slurred speech. I observed a strong odor of an alcoholic beverage emitting from his person, and from his breath when he spoke. I noticed that Mr. Billings had a class D license and was in violation, as it was between the hours of 12am and 5am. Mr. Billings stated something about having to get that renewed.
I asked him again how much alcohol he had consumed, and he advised me that he had consumed 2 shots of Hennessy, about an hour ago. When I asked him again how much marijuana he smoked, he then stated he doesn’t do that, and claimed he did not smoke any marijuana, and that it was somebody else who had smoked. Mr. Billings agreed to participate in field sobriety tests.
Mr. Billings did not have any medical conditions or ailments that would prevent him from participating. I began with the Horizontal Gaze Nystagmus evaluation (HGN). Mr. Billings had equal tracking, equal pupil size, and did not have resting nystagmus. During the test, I did observe a lack of smooth pursuit in both eyes. I did observe nystagmus in both eyes at maximum deviation, and I did observe nystagmus in both eyes on the onset prior to 45 degrees(6-6).
I observed that Mr. Billings was swaying and had slight body tremors. I explained and demonstrated the walk and turn evaluations. Mr. Billings began the test, and did not walk heel to toe, took 10 steps instead of 9 and stopped. Mr. Billings then asked what he should do next, and I advised that I had already explained the test to him. Mr. Billings then did the turn incorrectly and began walking back. He stepped off the line and did not walk heel to toe. (4-8)
I explained and demonstrated the one-leg stand evaluation. I did not observe any clues. (0-4) I then explained the modified Romberg test. During the test, Mr. Billings estimated the passage of 30 seconds, in approximately 35 seconds. Mr. Billings was swaying during the test, and I observed very slight eye tremors. I performed the lack of convergence test, and did not observe a lack of convergence. Mr. Billings consented to blow in a PBT, but due to not having any straws, I was unable to complete that task.
I advised Mr. Billings that he was under arrest for DUI. I placed him into handcuffs behind his back, and they were double locked and checked for proper spacing. I searched Mr. Billings incident to arrest for weapons, contraband, and means of escape. I located a pack of rolling papers in his pants pockets. Mr. Billings was placed into the back seat of my patrol car and secured with a seat belt.
I asked Mr. Billings how old he was, and he advised me he was 19 years old. I read Mr. Billings the Georgia Implied Consent for suspects under 21. Mr. Billings agreed to state-administered testing of his blood. Cpl. Perrin conducted a probable cause search of the vehicle, based on the odor of marijuana, and located a marijuana blunt roach in the cup holder in the center console of the vehicle. Cpl. Perrin advised dispatch to start the next list towing company, and Brown’s Wrecker arrived on scene. An impound report was completed.
I then transported Mr. Billings to Northeast Georgia Medical Center-Barrow, where the on-duty phlebotomist completed a GBI blood alcohol/toxicology report. I transported Mr. Billings to the Barrow County Jail without incident, where he was issued the following citations:

Once back at the Winder Police Department, the marijuana blunt roach and the rolling papers were given property receipt A#30985. They were placed into evidence locker #011. The GBI kit was given property receipt#A-30986. It was placed into the evidence fridge #018A. All items were given LERMS property receipts. A GBI Submission form was completed for the GBI blood kit.
