On 5/22/2026 at 1556 hours, I (Sgt. Wolfe) was requested by Cpl. Currington to respond to the First United Methodist Church, located at 208 N. Broad Street, as I have been trained in ARIDE (Advanced Roadside Impaired Driving Enforcement). Officers were dispatched to a welfare check regarding a male in a SUV who was lying back in the seat and was barely moving. Once officers arrived on the scene, they observed a marijuana pipe in plain view.

I began speaking with the driver of the vehicle, identified as Robert Kenney. Mr. Kenney stated that there was a pipe in the car, and when asked how he ended up in the church parking lot, he stated that he was just driving around and had just left Ingles. Mr. Kenney began speaking about how he and his mother were going to go to the Braves game later if the rain held out. Mr. Kenney stated he likes to just drive around.

I observed that Mr. Kenney was very fidgety and was shaking while he was in a seated position on the curb. Mr. Kenney was also picking the grass he was sitting in, and had grass over his clothing.

I asked Mr. Kenney when the last time he smoked marijuana was, and he stated that it had been a while, then stated it had been a couple of months. I asked if he had just forgotten he had it in there, and he stated that he did forget.

Mr. Kenney then proceeded to tell me that he was just going to go to the Braves game, then began talking about how he went to wash his car yesterday.

I asked him to stand up so I could speak with him further. Mr. Kenney stood up, and I began asking him if he had any medical conditions. Mr. Kenney stated that he had a liver thing for a while. Within a few moments of him standing up, Mr. Kenney was unsteady on his feet and began to fall backward, before throwing his arms in the air to catch his balance.

Mr. Kenney began to tell me that he takes 3 or 4 things, and at first claimed they were all blood thinners. Then he began to try to explain what other pills he took, and stated that they were not medical, or anything like anti-depressants, but could not tell me what pills they were or what they were for.

I asked him if he had ever done any illegal narcotics, and he stated that he did not, except for marijuana, but never did anything else. I asked about any alcohol, and he stated that he did not, due to the liver issue he suffered. Mr. Kenney then stated that the liver issue was 3 or 4 years ago.

While speaking with Mr. Kenney, I observed that he had bloodshot eyes, and his pupils were pinpoint/constricted. I observed Mr. Kenney had body tremors and was still shaking. When asked again if the only prescription medication he took was the 3 blood thinners, he stated yes, but then stated there was one blood thinner, and claimed that he did not know what the other prescription medications he takes were, or what they were for. Mr. Kenney stated that he normally takes them in the morning, but sometimes splits them in the evening. Mr. Kenney stated that he took them at 0730 this morning.

Mr. Kenney was in the driver’s seat, was in actual control of the motor vehicle, with the keys in the ignition, and agreed to participate in field sobriety evaluations.

I began with the Horizontal Gaze Nystagmus evaluation(HGN). Mr. Kenney had equal tracking, equal pupil size, and did not have resting nystagmus. During the test, I did not observe a lack of smooth pursuit in both eyes. I did not observe nystagmus in both eyes at maximum deviation, and did not observe nystagmus in both eyes on the onset prior to 45 degrees. Based on my training, knowledge, and experience, in individuals under the influence of certain narcotics, HGN will not be present. Mr. Kenney was swaying left to right, and I continued to observe body tremors. (0-6)

I then began to place Mr. Kenney in the instructional stance. Mr. Kenney had a hard time following my instructions and was eventually able to be placed in the instructional stance. I performed and explained the walk and turn. Mr. Kenney broke from the instructional stance before I advised him to begin. I asked him if he had any questions, and he just stated, “nine, nine, and turn left.” I asked him if he had any questions, and he did not have any. During the test, Mr. Kenney did not touch heel to toe, used his arms for balance, did an improper turn, took 10 steps after the turn, then, when he came to a stop at the end, turned and faced left. I explained and demonstrated the one-leg stand evaluation. Mr. Kenney did not have any questions. Mr. Kenney was unable to keep his foot off the ground, putting it down multiple times, used his arms to balance, and was swaying. (3-4)

I then explained the modified Romberg test. Mr. Kenney had a hard time listening to the instructions and kept his eyes open, even though I had explained he needed to shut them. I explained the instructions to him until he understood, and he did not have any other questions. Mr. Kenney estimated the passage of 30 seconds in approximately 27 seconds.

I performed the lack of convergence test, and both eyes converged.

I then advised Mr. Kenney that he was under arrest for DUI. Mr. Kenney was placed in handcuffs behind his back. They were double-locked and checked for proper spacing.

Mr. Kenney was searched incident to arrest for weapons, contraband, and means of escape. Nothing was located.

I placed Mr. Kenney in the back of my patrol car, and he was secured with a seat belt.

I read Mr. Kenney the Georgia Implied Consent for suspects 21 and over. I asked Mr. Kenney if he would submit to the state-administered test of his blood. Mr. Kenney began shaking his head no and stated his lawyer told him to say no. Mr. Kenney then stated that he wasn’t going to be able to go home anyway if he did, and something else about his lawyer. Mr. Kenney refused to take the state-administered test.

I transported Mr. Kenney to the Barrow County Jail without incident, where he was issued two citations:

I completed and served Mr. Kenney with the DDS1205 form, and the yellow copy was placed into his property.

The back seat was checked before and after Mr. Kenney was placed inside.
