On 08/30/2026 at 0524 hrs, I responded code 1 (non-emergency) to [20 BLOCK] Mulberry Rd, Winder Ga 30680 in reference to a domestic dispute, but the parties were separated.
Upon arriving at the scene, I came into contact with the caller, later identified as [VICTIM #1]. She stated that Ruben Martinez Vasquez had choked her. Due to a language barrier, I approached Ruben to speak with him. He indicated that he lives at the residence and that [VICTIM #1] had been staying with him for two days. He described her as a heavy drinker and someone who uses illegal substances, and claimed he did not understand why [VICTIM #1] called the police.
Ruben mentioned that he had known [VICTIM #1] for almost eight years and that she often stayed at his place for months but always left due to her drug use. He stated that they had been drinking outside when a verbal argument broke out. Ruben insisted that he often helps [VICTIM #1], but that night she called him a bad person. He claimed to have consumed five to six Modelo beers that evening. Ruben said [VICTIM #1] became irrational, and he tried to calm her down by placing his arm on her back to guide her inside. He recounted that [VICTIM #1] then shouted, “You’re choking me,” and he was puzzled by her reaction. Ruben repeatedly claimed that [VICTIM #1] was “crazy” and a drug addict.
I then spoke with [VICTIM #1], who confirmed that she and Ruben had been outside drinking with others. She stated that around 4 am, she called an Uber to leave and went inside to retrieve her belongings from the drying machine. [VICTIM #1] explained that they were former roommates and that she even had a key to the room. She returned that day because Ruben had asked her to clean out her room in preparation for cleaners dealing with black mold. [VICTIM #1] alleged that Ruben approached her inside, placed both hands on her throat, and asked, “Do you want to die?” During the altercation, she said she felt like she needed to use the pee and felt asphyxiated. [VICTIM #1] then ran outside, followed by Ruben, who allegedly tackled her to the ground. She managed to get back on her feet and escape, stating that Ruben disappeared after that, prompting her to call 911.
Med 9 arrived to evaluate [VICTIM #1], but she refused any further treatment. Upon examining the scene, I found Ruben’s phone on the other side of the road, near where [VICTIM #1] stated she was tackled. Additionally, [VICTIM #1]’s pill bottle was discovered further down the road, supporting her claims of trying to escape. I did not observe any redness on scnene on [VICTIM #1]’s throat due to the fact of her skin complexion, and it was nighttime. I questioned Ruben about his phone, and he checked his pockets, claiming he did not know where it was. When I informed him of its location, he stated that [VICTIM #1] had taken his phone.
Given the circumstances, I placed Ruben’s hands behind his back, applied handcuffs, checked for fit, and ensured they were double locked. He was then secured in my patrol vehicle with a seatbelt. [VICTIM #1] was provided with a family violence plan and informed about the available resources. Ruben was transported to the Barrow County Detention Center, where he was booked without any further issues. My patrol vehicle was searched both before and after transport, and no contraband was found.
Ruben will be charged with the following.
OCGA 16-5-21(i) Aggravated Assault Strangulation FV. Ruben placed both hands around [VICTIM #1]’s throat, causing her to have the sensation of having to pee and asphyxiation. Ruben and [VICTIM #1] were formerly roommates at the time of the altercation.
OCGA 16-5-23(f) Simple Battery FV. Ruben placed his hands unwanted on [VICTIM #1]’s back in an attempt to bring her back inside the residence. Ruben and [VICTIM #1] were formerly roommates at the time of the altercation.
