On 06/05/2026 at 2339 hours, I ( Sgt. Wolfe) was on routine patrol traveling eastbound on W. Athens Street, Winder, GA, when approaching the intersection of N. Beulah Street, a red four-door vehicle failed to yield, and made a left turn directly in front of my patrol vehicle. I had to slam on the brakes and take a quick evasive action off the roadway in order to not to strike the vehicle in a T-bone fashion. I activated my emergency lights and made a U-turn to catch up to the vehicle.
The vehicle, a red Toyota Corolla (GA TAG#[REDACTED]) had stopped in the roadway on W. Athens Street after the near collision, and then turned to go north on Church Street. I caught up to the vehicle, and it stopped on Church Street. I made contact with the driver, Thomas Hall, and I asked him what was going on tonight. I immediately observed a strong odor of an alcoholic beverage emitting from inside the vehicle. Mr. Hall stated, “I’m Sorry man, I just didn’t see you.” I asked him where he was coming from tonight, and he stated that he just got an apartment and pointed down the street. Mr. Hall then paused and just continued looking forward. I observed that he had bloodshot, watery, glossy eyes. I advised dispatch to start me a second officer.
Ofc. Perry arrived on scene, and I asked Mr. Hall to step out. I walked him to the back of my patrol car. I observed a strong odor of an alcoholic beverage emitting from his person when he spoke. I asked him how much he had to drink. Mr. Hall denied having any alcoholic beverages. I asked him why I would smell that coming from his person, and he stated he didn’t know. I asked when the last time he had any alcoholic beverage at all. Mr. Hall paused, sighed, and stated: “he couldn’t tell me.” I asked him where he was coming from again, and he stated that he went to the gas station to get Zyns. I asked him if he would be willing to participate in field sobriety evaluations, and he stated, “No, Sir.” I asked if he would be willing to take a portable breathalyzer (PBT), and he stated, “That would be fine.”
I retrieved my department-issued PBT, and Mr. Hall blew into it. It did have a positive result for alcohol. While Mr. Hall was blowing into the PBT, I continued to observe a strong alcoholic beverage emitting from his breath.
I advised him that he was under arrest for DUI. I placed Mr. Hall in handcuffs behind his back. They were double-locked and checked for proper spacing.
I searched him incident to arrest for weapons, contraband, and means of escape. Nothing was located. Mr. Hall was then secured into the back seat of my patrol car with a seat belt.
I read Mr. Hall the Georgia Implied Consent for suspects 21 and over. When asked if he would submit to the state-administered chemical test of his breath. Mr. Hall stated no.

Mr. Hall refused implied consent. I advised dispatch to start the next list towing company. Myle’s Wrecker Service arrived on scene, and the vehicle was towed away. An impound report was completed.
While waiting for the tow truck, and en route to the jail. There was a very strong odor of an alcoholic beverage inside my patrol car, due to Mr. Hall.
I transported him to the Barrow County Jail without incident, where he was issued the following citations:
#WC002377 failure to yield-left turn
#WC002378 DUI- 1st offense
I completed and served Mr. Hall with the DDS1205 based on his refusal to state-administered testing. Mr. Hall signed the DDS1205. The yellow copy was placed in his property at the jail.
