On 09/11/2026 at 1502 hours, I, Officer A. Howe (#W157), was dispatched to the intersection of Vision Street and Exchange Blvd, Winder, GA 30680, regarding a traffic accident. Barrow County Dispatch advised that the parties were actively arguing and not separated. Therefore, I traveled code 3 (lights and sirens) to the scene.

I arrived on scene and separated the parties: a white male and a black male. I spoke with the white male first while Officer Morgan (#W115) spoke with the black male. The white male identified himself as the caller, [VICTIM #1] (DОB: [REDACTED BY AGENCY]). [VICTIM #1] stated that he had been rear-ended by the other party, and that he immediately pulled into the parking lot of a local business. [VICTIM #1] stated that the other party then became hostile, yelling profanities and threatening him. [VICTIM #1] stated that his nieces were in the back of his vehicle, and that he was worried for them due to the other party’s tumultuous manner.

I then spoke with the other party, Willie Smith (DOB: [REDACTED BY AGENCY]). Smith stated that he had gotten out of his vehicle, and told [VICTIM #1] to not record his vehicle. While speaking with Smith, I could smell the odor of marijuana emitting from his vehicle. I conducted a probable cause search of his vehicle (GA TAG: [REDACTED]). The search yielded 2 cigarillos containing suspected marijuana (6.98 grams), which were in the center console.

I found there to be probable cause to place Smith under arrest for Disorderly Conduct, Possession of Marijuana Less than 1 Ounce, and Following Too Closely (CITATION NUMBERS: WC009093, WC009094, WC009095). Smith was placed in handcuffs, which were checked for proper fit and double locked. Smith was searched incident to arrest for contraband, means of escape, and weapons, which yielded negative findings. I allowed Smith’s wife to take possession of his vehicle. [REDACTED] (DOB:[REDACTED BY AGENCY]) had a valid driver’s license, and the vehicle was released into her custody without incident. Smith was transported to the Barrow County Detention Center in marked patrol vehicle #379 and wore a seatbelt during transport. Smith was released into the custody of Barrow County deputies without incident. Following the transport of Smith, I checked my back seat for weapons, contraband, and means of escape, which also yielded negative findings.

[VICTIM #1] completed a witness statement form, which will be attached to this report. A LERMS entry and property receipt (A-29944) were completed for the suspected marijuana, which was placed into temporary evidence locker 011.
