On Wednesday, September 9, 2026, I responded to Joe Frank Harris Pkwy., Cartersville, Georgia, in the area of Piedmont Hospital, in reference to Eric Cano walking in the roadway while mastu*bating and exposing himself.

Upon my arrival, I searched the area for Eric and observed him lying between two concrete barriers. Upon exiting my patrol vehicle and approaching the barriers, I observed Eric lying on the ground completely nude, with his sexual organs exposed, while mastu*bating.

Eric was instructed to stop mastu*bating and comply with my verbal commands. Eric initially failed to comply and continued mastu*bating. I gave Eric additional verbal commands to stop mastu*bating and comply. Eric subsequently stood up and jumped over the concrete barrier.

I instructed Eric to return over the concrete barrier and put on his clothing. Eric complied with my commands and put on his clothing.

Eric was then placed in handcuffs. I collected Eric’s belongings, and Eric was transported to the Bartow County Jail.

All events occurred in Bartow County, Georgia.

NOTICE OF INTENT TO RAISE INSANITY, MENTAL ILLNESS, OR INTELLECTUAL DISABILITY DEFENSE FILED

What this means: Defense attorneys Kelley Dial filed notice that they intend to raise the issue of insanity, mental illness, or intellectual disability at the time of the alleged act. The defense is notifying the court and prosecution that they plan to argue at trial that Eric Eduardo Cano was not mentally responsible for his conduct due to mental illness, insanity, or intellectual disability. This notice is required by law and allows the prosecution to prepare a response. It does not mean the defense has proven any mental condition — only that they intend to present this argument.

DEFENDANT’S SPECIAL PLEA OF INCOMPETENCY TO STAND TRIAL FILED

What this means: Eric Eduardo Cano’s defense attorneys, Kelley Dial, filed a special plea asserting that the defendant may be incompetent to stand trial. This plea raises the question of whether Cano is mentally capable of understanding the charges against him and assisting in his own defense. If the court finds merit, it may order a competency evaluation by a mental health professional. The case cannot proceed to trial until competency is resolved.

BOND HEARING HELD

What this means: Eric Eduardo Cano was released on an own recognizance bond in Bartow Superior Court on September 17, 2026, per Judge Bryson, in connection with case number SUW2026002252. The bond was approved by Deputy Sheriff Plummer. An own recognizance bond — sometimes called an OR bond — means Cano was released without having to pay any money upfront. Instead, he signed a written promise to appear in court as required. Failure to appear would result in a warrant for his arrest. The bond document lists Cano as homeless, and his next court date was noted as to be mailed. The charge listed on the bond is public indecency, under warrant number CE0183356.
