Four arrested after following 16-year-old driver for over 30 minutes

BARTOW COUNTY – A parent’s worst nightmare was realized after her 16-year-old son was followed by 4 adults in two separate vehicles for over 30 minutes after leaving his girlfriends house on Walnut Lane in Cartersville.

Tius Baillio, Nichole Baillio, Joseph Baillio, and Maxine Baillio were all charged with misdemeanor stalking.

“This is something you can’t preach enough to your kids about being aware of your surroundings”, said the victim’s mother.

Officer’s Narrative:

On Tuesday, June 16th, 2021, at 0055 hours, I was dispatched to the area of Main Street and Bartow Street, Cartersville, GA, 30120, in regards to a Stalking report.

Upon arrival, I spoke to Lt. Beal, who was out with [VICTIM #1] and the listed Honda Accord. Lt. Beal told me [VICTIM #1] had left his girlfriend’s residence [on] Walnut Lane, Cartersville, GA, 30120, around 2345 hours on 6/15/2021 to drive home to [REDACTED] Street Cartersville, GA, 30120.

Lt. Beal said [VICTIM #1] told him while he was traveling through town, he noticed someone in the listed Dodge Charger and listed Dodge Challenger had been following him since he left the area of Keith Road and Peeples Valley Road.

[VICTIM #1] said he made a U-Turn at West Avenue and Euharlee Road and began to take unknown roads he usually did not take, and the vehicles continued to follow him. [VICTIM #1] continued to drive onto unknown roads in an attempt to get the vehicles to stop following him for approximately 30 minutes, and they continued. [VICTIM #1] called 911 at this time.

While [VICTIM #1] on the phone with 911, he said the Dodge Challenger pulled in front of him, and a subject inside pointed something at him, but he did not know what it was.

[VICTIM #1] was then approaching a red light on an unknown road, and while coming to a stop, the male driver of the Dodge Challenger, later identified as Joseph Baillio, exited the Challenger and began to walk towards [VICTIM #1] vehicle. [VICTIM #1] told me he then failed to obey the traffic control device after making sure the intersection was clear to get away from the male.

Sgt. Cole with the Cartersville Police Department was able to perform a traffic stop on the Dodge Charger at Buford Street and Jones Mill Road in Cartersville, GA, 30120. [VICTIM #1] then continued driving and stopped in the area of Bartow Street and Main Street. [VICTIM #1] noticed his vehicle had been hit with two eggs once he stopped. Sgt. Cole told me Nichole Baillio drove the Dodge Charger, and the passenger was Maxine Baillio.

Sgt. Cole said they also knew who was in the Dodge Challenger, and it was driven by Joseph Baillio and had a passenger Tius Baillio.

Sgt. Cole told me all parties told him while they were at their residence at [10 BLOCK] Scarlett Oak Driver, Cartersville, GA, 30120, when they observed a male in the listed Honda Accord drive by their residence and screamed out the window that a nine-year-old boy who lives at this location was a rapist.

At this point, Nichole, Maxine, Joseph, and Tius got into the Dodge Charger and Challenger and began to follow the Honda Accord. They followed the Honda for approximately thirty minutes and never made any attempt to contact law enforcement in regards to harassment.

All subjects declined throwing eggs at the Honda; however, all parties did admit to following and placing the honda under surveillance because they wanted to identify the driver of the Honda.

After further investigation, it was determined [VICTIM #1] only sixteen years of age and does not know the individuals who were following him and was only in the same neighborhood due to him having to drive by their house to get to his girlfriend’s residence.

When I spoke to J****** , [VICTIM #1]’s step dad, he confirmed [VICTIM #1] did not know the individuals who followed him and was only in the area to see his girlfriend.

At this point in the investigation, J****** and R****** , who are [VICTIM #1] legal guardians came to the decision they wanted to press charges on all four individuals for following their child and placing him in a state where he felt as if he was going to be hurt or worse if he was not able to get away from them.

J****** arrived on the scene and gained possession of the Honda due to [VICTIM #1] only having a Class D license and he was now restricted to drive due to his curfew. Four warrants for Stalking were taken for Nichole, Maxine, Joseph, and Tius’s arrest.

The warrants for Stalking were issued based on the facts of all individuals telling law enforcement they got into their vehicles for the sole purpose at to follow and survive [VICTIM #1] and continued to follow him for approximately thirty minutes before being stopped by law enforcement. All individuals had no legal reason to follow [VICTIM #1] and make him feel intimidated and scared for his safety.

Sgt. Cole was wearing a body-worn camera during this incident. Sgt. Cole had released all four individuals from the traffic stop scene before R****** and J****** had decided to press charges; therefore, this case is left active pending the arrest of all four individuals.

Lt. Beal’s and my body-worn camera were recording during this incident as well. The charge of Criminal Trespass-Damage To Property is unfounded due to [VICTIM #1] not knowing who threw the eggs on his vehicle, not knowing where it occurred, or how it occurred.
