Officer’s Narrative:

On May 26th, 2026, at approximately 2356 hours, I responded to the area of Hwy 41 at Mac Johnson Rd, Cartersville, GA 30120, in reference to Officer Silvers with the Adairsville Police Department, stating he observed a silver in color Toyota Tundra cross over the median and begin driving southbound in the northbound lanes of travel until turning into the Food City. Deputies located the vehicle at Racetrac on Hwy 41 at Baker Rd.

I made contact with the driver, Gabriel Hever, who was placing a case of beer in the rear seat of the vehicle. I observed Gabriel to have bloodshot eyes. I asked Gabriel where he was coming from. Gabriel stated he was coming form his residence which is on Burnt Hickory Rd. I asked Gabriel if he had just come from Food City, to which he stated he had. I asked Gabriel if he realized he was driving the wrong way on the road. Gabriel stated he was not sure. While speaking with Gabriel, I noticed a strong odor of an alcoholic beverage coming from his breath. Gabriel provided me with a drivers license through Illinois. Gabriel stated that his license were expired. Gabriel stated that the passenger of the vehicle did not have a drivers license.

I then contacted Officer Silvers by phone. Officer Silvers advised me that he observed the vehicle drive from Mac Johnson Rd, drive over the median on Hwy 41, and travel southbound in the northbound lanes on Hwy 41 until turning into the Food City. Officer Silvers stated he was unable to stop the vehicle at the time due to dealing with a separate incident. It should be noted that Gabriel was on the drivers side of the vehicle when he was located, and the passenger, [REDACTED], was observed sitting in the passenger seat. There were no other subjects located during the time of contact, making it clear that he was the driver of the vehicle.

I then repeated what Gabriel had stated to me to him to make sure his statement was correct. Gabriel stated he tried to make a stop at the CVS pharmacy, but they were closed, which I believe he was speaking about Food City. I asked Gabriel how much he had to drink tonight. Gabriel stated approximately 4 beers, 2 hours ago. I asked Gabriel if he would participate in field sobriety testing. Gabriel stated he would.

At this time, I began standardized field sobriety testing with Gabriel. I asked Gabriel if he had any head injuries and if he wore glasses or contacts. Gabriel stated no. I then began the HGN test. I observed Gabriel’s eyes to be bloodshot and watery. I observed Gabriel’s pupils to be equal in size. I observed Lack of smooth pursuit, Distinct and sustained Nystagmus at maximum deviation, and Onset of Nystagmus prior to 45 degrees (6/6 Clues). It should be noted that I observed Vertical gaze Nystagmus as well, which can be observed with high doses of alcohol intoxication. I then began the Walk and turn test. During the instructional stage, I observed Gabriel unable to maintain his balance. During the test, I observed Gabriel make an improper turn by not taking a series of small steps as instructed, and stepping off line (3/8 Clues).

I then began the One leg stand test. I observed Gabriel put his foot down, sway, and use his arms for balance (3/4 Clues). Based on my knowledge, training, and experience, I found Gabriel to be under the influence of alcohol. I asked Gabriel if he would provide a breath sample with a PBT, but he refused. I placed Gabriel in handcuffs behind the back, checked them for proper fit, and double locked them. I read Gabriel’s implied consent notice for suspects over the age of 21, which he agreed to a blood draw. Upon checking Gabriel’s license, I observed that his license had expired on 03/21/2026.

I transported Gabriel to Piedmont Cartersville Hospital, where a blood draw for the GBI blood kit was obtained. Other deputies remained on scene until the vehicle was turned over to a family member. I then transported Gabriel to the Bartow County Jail. I issued Gabriel uniform traffic citations for DUI Less safe, Driving on the wrong side of the roadway, and driving while license is expired.
