On Monday, April 29th, at 2249 hours I was dispatched to [4400 BLOCK] Brandy Lane, Acworth, GA 30102 in reference to an assault that had just occurred.
Upon arrival I met with [VICTIM #1]. [VICTIM #1] stated his neighbor, Jerry Lyons came over to his house due to an argument they had over the phone. [VICTIM #1] stated after they began arguing he asked Jerry to leave his property at least three times, and Jerry refused. [VICTIM #1] stated after Jerry refused to leave he attempted to go inside his house by opening his glass storm door, when Jerry grabbed him by the right shoulder of his t-shirt. [VICTIM #1] stated when Jerry grabbed him he pulled him back, which caused his shirt to rip, and then punched him in his right eye/cheek causing a large bruise, and some small cuts, which I photographed with my body worn camera. [VICTIM #1] stated Jerry then left the property.
I then met with [WITNESS #1]. [WITNESS #1] stated he witnessed this incident from just inside [VICTIM #1]’s front door, which was open. [WITNESS #1] stated this incident occurred exactly as [VICTIM #1] described.
I then relocated to Jerry’s residence at [4400 BLOCK] Brandy Lane. Jerry stated [VICTIM #1] invited him over to his house following an argument on the phone. Jerry stated [VICTIM #1] started cussing him out, tried to hit him with the glass storm door, and then threatened to “beat his a*s”, so Jerry hit him one time, which made [VICTIM #1] fall. Jerry stated he left after punching [VICTIM #1].
Jerry was placed under arrest in handcuffs to the rear, placed in the rear of a patrol vehicle, and transported to the Bartow County Jail where he was turned over to jail staff without further incident.
Warrants have been secured for Jerry for battery on someone 65 or older, criminal trespass – trespass on property, and criminal trespass – damage to property.
