At approximately 1954 hours on Sunday, May 8th, 2022 I was dispatched to [300 BLOCK] Cook Street, regarding an incident that occurred at Cartersville Trucks, located at 5500 GA-20, in Cartersville, Georgia.

Upon arrival, I spoke to the Suspect/Victim, Joshua Thomas, who said that his Ex Father-In-Law, [WITNESS #1], threatened to kill him at the incident location. Joshua advised me of an incident in Fairmount, Georgia that involved him and Victim [VICTIM #1] traveling together to drop off one of her children. Joshua advised a dispute started, to which the Fairmount Police Department was advised of the incident.

Joshua said while traveling down GA-20 a Police Officer with the Fairmount Police Department contacted him advising him that he needed to return to Fairmount to state the incident. Joshua said he pulled over and [VICTIM #1] exited the vehicle at the incident location. Joshua said he pulled over to have [VICTIM #1] drive, to which she refused. Joshua said the listed juvenile [REDACTED BY AGENCY] was secured in the backseat of the vehicle.

Joshua said [WITNESS #1] and [WITNESS #2] arrived on the scene and started to verbally argue with him. Joshua said [WITNESS #1] told him that he was going to kill him and end his life. [Joshua] said he attempted to avoid contact with [WITNESS #1] and contacted 911. [Joshua] then relocated to [300 BLOCK] Cook Street, where I met him.

I spoke to Joshua’s mother, [WITNESS #2], who said she received a phone call from [WITNESS #1], to which she heard two male voices arguing. [WITNESS #2] said she heard a male voicing yelling to get your a*s out of the car. [WITNESS #2] said that [VICTIM #1] moved into the residence on the previous date with Joshua and that her items were inside the residence. [WITNESS #1], [VICTIM #1], and [WITNESS #2] all arrived on the scene.

I spoke to [WITNESS #1] regarding the incident. [WITNESS #1] advised while commuting on his motorcycle with [WITNESS #2] he observed [VICTIM #1] walking away from Joshua. [WITNESS #1] said he made a u-turn and drove to his location of Joshua. [WITNESS #1] said he did not want Joshua around and that he is trouble. [WITNESS #1] said at no point did he threaten or harm Joshua. [WITNESS #1] said he just wanted Joshua away from [VICTIM #1] due to him observing [VICTIM #1] walking away from Joshua. [WITNESS #1] said he then relocated to his residence which was right beside Cartersville Trucks.

I spoke to [WITNESS #2] regarding the incident. [WITNESS #2] advised she saw [VICTIM #1] walking away from her vehicle, which Joshua was driving. [WITNESS #2] said [WITNESS #1] went to speak to Joshua. [WITNESS #2] said [WITNESS #1] never threatened Joshua. [WITNESS #2] said nor did the dispute become physical. [WITNESS #2] said [WITNESS #1] did not provoke the incident and just spoke to Joshua to stay away from [VICTIM #1].

I spoke to [VICTIM #1] regarding the incident. [VICTIM #1] advised she was traveling with Joshua in the vehicle throughout Bartow County, Georgia. [VICTIM #1] said she received a phone call from a Fairmount Police Officer. [VICTIM #1] said the officer told her to return to the Fairmount Police Department to get statements from both Joshua and [VICTIM #1]. [VICTIM #1] said Joshua refused to return so she told Joshua to pull over the car which was at the incident location.

[VICTIM #1] said she did not want to get in trouble so she exited the vehicle to make arrangements to go back to Fairmount, Georgia. [VICTIM #1] said she was walking away when her Father and Mother, [WITNESS #1] and [WITNESS #2], observed her walking away from Joshua and the vehicle. [VICTIM #1] said while she was walking away she did not observe her father [WITNESS #1] make any threats of violence.

Dispatch contacted Jail staff to confirm there was an active bond order. Jail staff confirmed there was an active bond order that ordered Joshua to stay away from [VICTIM #1]. The bond order was set by Chief Superior Court Judge Scott Smith, of the Superior Court of Bartow County, which was signed on the 4th Day of January 2022. I observed a copy of the bond order to verify the conditions set forth by Judge Smith. A copy of the bond order was provided to all required parties.

Joshua was placed under arrest and transported to the Bartow County Adult Detention Center without further incident. [VICTIM #1] took possession of [REDACTED BY AGENCY] due to her having custody of the child and Joshua (the biological father) being incarcerated. [VICTIM #1] removed her property from the residence. I provided a case number to [VICTIM #1] regarding the incident. The terroristic threats charge was unfounded due to conflicting statements from all parties.
