On Tuesday, July 1, 2025, at approximately 2123 hours, I responded to [6600 BLOCK] Wagonwheel Dr SE Acworth, Bartow County, Georgia in reference to a domestic disturbance.
Upon arrival, I met with Lisa Muse, who advised her husband Malcom Piper kicked her in the stomach. Lisa advised the incident began when Malcom told her he wasn’t going to pay any more money for her sick dog. Lisa advised she obtained a cane and began swinging it around. Lisa advised Malcom then kicked her in the stomach, and she threw her cellphone at him. According to Lisa, she was freaking out and had “fight or flight”.
I asked Lisa if she swung the cane at Malcom first. Lisa advised yes, but then said she was just swinging the cane as she was talking. Lisa advised she was not swinging it at Malcom. I asked Lisa if she ever came close to hitting him, and she stated “no, but I wanted to”. I asked Lisa if she thinks Malcom kicked her because she was swinging the cane around, and she stated he might have. Lisa showed me the cane she was swinging. The cane was black and appeared to be made of metal.
I checked Lisa for injuries, and I observed a red scratch mark on her stomach. Lisa advised she believes the mark was from Malcom kicking her but she is not sure. Lisa advised the mark was not there before. I obtained photographs of her injuries.
I spoke with Malcom about the incident. Malcom advised he returned home today for his birthday to get some mail. Malcom advised Lisa loaned her vehicle to a friend and wanted him to take her to Ingles to get a pork loin for their sick dog. Malcom advised he refused to give her a ride, so she became irate and started swinging a cane around. Malcom advised Lisa was beating the house (as in she was hitting things with the cane) and swinging the cane in his face.
I asked Malcom how close the cane came from striking him. Malcom advised the incident occurred on the porch and it was dark, but he believes about a foot and a half. I asked Malcom if he kicked Lisa in the stomach. Malcom advised he kicked at her, but he didn’t mean to kick her in the stomach. I asked Malcom why he kicked Lisa, and he advised it was to get her away from him. I also asked Malcom about Lisa throwing her cellphone at him. Malcom was unaware that she had thrown her cellphone.
Malcom advised Lisa damaged things in the house. I had him take me inside the residence, and oncе inside he could not locate anything damaged. While inside the residence Malcom confirmed the cane Lisa had previously shown me was the one she used to swing at him.
After gathering statements from Lisa and Malcom, Lisa was placed under arrest for aggravated assault for swinging the metal cane at Malcom. The offense of aggravated assault was charged under the family violence act, due to Lisa and Malcom being present spouses. The offense of battery was unfounded due to Malcom acting in self-defense as Lisa was swinging the cane at him.
Lisa was transported to the Bartow County Jail where she was refused during the intake process due to high blood pressure. I then transported Lisa to Piedmont Cartersville Medical Center. Once Lisa was cleared by hospital staff, I transported her back to the Bartow County Jail where custody was exchanged with Bartow County Jail staff.
Photographs of the cane were obtained.
